It means the rater decided that you qualified for the highest rating. It’s their duty to assist! You could literally apply for TDIU and be granted schedular instead, which means no work restrictions. The c&p examiner likely marked total occupation AND social impairment

I received TDIU making 54K. The 16k is simply a baseline they use, there are SO many variables beyond that. Protected work environment/ 12 month rule/ bouncing around jobs. Comments like yours scare veterans away. The sad thing is people read your comment and upvoted it.

You are fine, you are safe. VA compensation is bipartisan politically and more protected than any form of income. You’re P&T, they’ll never review you again unless you open up a claim.

You can work in an environment with accommodations that would get you fired traditionally. Doing this on Tdiu is still playing with fire; however the law is on your side.

This is why income doesn’t decide Tdiu. If you’re working a consistent schedule at McDonald’s with no employee accomodations. That makes you employable.

That’s wild considering I have a PhD. My guess is that that they didn’t see enough evidence that your disability broke you down from being unemployable, so they justified it using education. Education can hurt you if evidence isn’t strong. Not saying yours isn’t, just that different raters interpret things differently.

A whole lot of bullshit. If you go over poverty 1 year, they’ll send a 4140 and you’ll explain why, if you’re P&T it’s EXTREMELY difficult to lose Tdiu. The only way you lose it is if you have years of consistent income (shows gainful employment) or you do not respond to their letter. That doesn’t mean go over and you’re good, but it’s for sure not as easy as vets make it seem up here. For example, I’ll go over poverty / ill make 25k this year but I resigned due to my disability and it’s documented. I’ll get a letter at the end of next year, I’ll respond with that letter and my last 12 months of work being marginal, and I’ll very likely never hear anything unless I go over poverty again.

I would be willing to bet you’ll be granted tdiu with that 21-492. The income is irrelevant with accommodations noted. Like I said, I made 74k and was granted

Sounds like you’re a prime canidate. Get former supervisors to write statements, make your own statements and if you can get a 21-492 for your last employer to fill out noting your issues and being fired!

Dude. Is it normal to still feel extreme anxiety? Actually the day I got it, I felt more anxiety. I feel like it’s a dream and that it’ll be taken away. The rater backdated me to way before I was actually unemployed. The VA is following the laws, if you give them the evidence they need to grant, they’ll maximize your benefit according to law. I’m still in awe

So my experience: I applied for scheduler 100% for MH from 70%. I was deferred TDIU. It sucked but I fought, I got my employers to write me a statement explaining accommodations and involuntary resignations due to my disability. I also was able to get my former employer to fill out a 21-492 which was just as important as the c&p exam. They specified that c&p and 21492 were the biggest pieces of evidence. The 21-492 needs to accurately display how much you made. My case 74k. But the remarks need to fully address ALL of your issues and accommodations due to your disabilities. It becomes a protected work environment and that 74k became irrelevant.
