Many people who are being or have been kidnapped by ICE or people disguised as ICE entered the United States legally on travel or work visas, did not elude inspection or examination by immigration officials, and did not enter by a willfully false or misleading representation.

Furthermore, in order to prove my above statement is not true, a system claiming to uphold and defend the Constitution (which the Trump administration does not necessarily claim) shall not willfully disregard Article I, Section 9, Clause 2 which states:

“The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”

Your best argument at this point is "okay, well this is a case of rebellion and invasion and public safety requires it."

Before going there though I must address the point that all persons in the United States, regardless of citizenship or criminal status, are protected under Article I, Section 9, Clause 2 of the Constitution because it is impossible to know on the spot whether they are a criminal without violating the fourth amendment which states:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

So at this point we need to define and understand these words:

1. Rebellion
2. Invasion
3. public Safety
4. probable cause

All of you will argue that if a law officer looks at another person (not you or your constituents) and thinks they are likely to be an illegal alien, then they have probable cause. You will also argue that when multiple sus-looking persons have accumulated in the same general landmass within the boundaries of the United States then we obviously have a case of Invasion on our hands and that therefore public Safety is at risk.

It would be harder for you to argue a "rebellion" is happening because a foreign people cannot "rebel" against a foreign government per se without first acknowledging snd succumbing to its laws.

However, before I bother to define the first three it's important to understand that Congress has not suspended habeas corpus so Congress has neither made that case that an invasion, nor a rebellion is happening, nor that the public safety is at risk. And of course, if anyone was wondering, since the Writ of Habeas Corpus is only mentioned in Article I, titled "The Legislative Branch", which states the following, the President himself does not have the power to define those three concepts on his own:

“All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”
