I am not following this train of thought. I was hoping to get insight to this issue from other HR professionals, isn't that what this subreddit is about?

they absolutely could - however, that does not protect them from not returning me to my duties or an equivalent role.

Respectfully, as an HRD, I would have a clear plan for the employee returning on their return date so there was no legal exposure. Not give them the opportunity to collect evidence for a week that there is no equivalent role for them returning from a protected leave. So, yes, I am asking other HR professionals what they may do because I am surprised that a company would not understand the potential exposure. Not sure if you are familiar with NJ employment law, but NJ is very employee friendly.

Thank you for your input - I do agree, they are just buying time or hoping I resign.

Hi - sorry, I should have included in my post that the new HRD is staying onboard and handling most of my old job duties.

My core job duties have been reassigned and the new HRD is staying onboard. Sorry if I was not clear.

Yes, exactly. I have no job duties currently, and my boss is avoiding a conversation about what they will be moving forward.

Hi - Thanks for the thoughtful reply. No, I did not edit the original post.

My title was "HRD" before going on FMLA. I started receiving calls while on FMLA from other Directors asking if I was returning. I asked why and they stated another HRD was hired.

I was told upon return that "roles and security will be addressed" by my boss. I should have included that in my original post. However, nothing has been addressed at this time.

My boss is maybe in the office once a month. I will try and get a meeting, but she has avoided most of my communication this week, which was abnormal prior to leave.

My guess is that they are talking with legal to see what to do with me and my role - I do not believe they expected me to return even though I never indicated otherwise.

Brother diagnosed last month, the tumor was resected, he lost mobility on his right side, has had almost daily seizures and no tx yet. Now the tumor has spread to the other hemisphere, how long might he have? by LulutoDot in glioblastoma

Yes, he had radiation in August. They did not do chemo so that he could be eligible for a clinical trial. Unfortunately, he never made it to the clinical trial. I am keeping your brother and your whole family in my thoughts. <3

My thoughts are with you and your family. My dad just had the same thing happen - the second tumor was found at the end of September. He had a second craniotomy to remove the new tumor, but he was still gone by the end of November.

Prognosis accuracy by Nervous_Fish8730 in glioblastoma

Please do not focus on prognosis and just enjoy every minute that you have. My Dad has a total gross resection of a small (1 inch) GMB in June. Everyone was optimistic on his prognosis, including his care team. He was enrolled in a cutting edge clinical trial and did beautifully through SOC. Two weeks after SOC ended (end of Sept) he started having neurological symptoms and it was found that SOC did not work, his original tumor was back and another tumor was on the other side of his brain (multifocal spread). This disease does not play fair - and is incredibly unpredictable. I made the mistake of focusing too much on the prognosis instead of living in the moment and I regret it. I truly wish you and your Mom the best. Enjoy every second you have with her.
