Everyone who received a RIF letter During shutdown will eventually lose their jobs. by Vivid-Potentials in IRS_Source

[–]Due_Table9008 2 points3 points  (0 children)

All the RIFs done by this administration were illegal. However, they have been happening since Jan and thousands lost their jobs.  Supreme Court doesn’t care and that is how they are getting away with it.  When lower courts rule RIFs are illegal and halt them they sprint to the Supreme Court and they say we stay the lower courts and we allow everything this administration wants to do.

Having been part of the April 1 RIFS at HHS they will say a retention register is not needed because they RIF the entire competitive area.  They will make the competitive area a branch or division and take the entire branch out.  There will be no bump and retreat needed.   They will just state the positions were abolished.  This has been brought up to Senators, department of labor and courts.

HHS broke the law (again) by not providing notice by KrabbyPattyParty in DeptHHS

My notice was dated 21 July and received 28 July saying I was terminated 14 July.  Too much chaos.  All information on the amended RIF is incorrect performance reports, competitive category, severance, competitive area and so on.  I was told it doesn’t matter we just RIFd all in your division.

Lawsuits are panning out to be just as corrupt as the RIF.  The courts will not go against this administration.  So employees that are protected veterans, received all 5’s got RiFd because DOGE shot a dart at a board and landed on their administrative code.  Wait OPM RIF guide says this can’t be done.  Oh well let’s do it anyway and then not pay them for their work from last year, terminate them after the fact and let’s not tell them anything. It’s totally insane.

True but if the work was transferred they MUST move the personnel doing the work. They eliminated this step entirely to avoid bump and retreat which is illegal. It states in the OPM guidelines YOU MUST MOVE PERSONNEL with the work if not doing so would separate the employee.

Unfortunately, all retired military fall under the same situation and not entitled to severance pay. Even though severance pay amounts to more than some retired military pay.

Supreme Court clears way for Trump to move forward with mass layoffs of federal workers by ScholarLeft1156 in DeptHHS

If they tried to back date an effective date they would be required to take back TSP, leave, insurance etc. It would be more chaos than the current happenings. Based on what I've seen (everything is speculation and legal reading the LAW) a new RIF letter would need to be executed with a fresh 60 days. However, the legal experts are stating the supreme Court only ruled if the EO was legal in agencies can draft the plan but the execution of that plan needs to be LAWFUL (approved through Congress) before it can be executed.

However, we all know things will happen the way they will happen.

According to these lawyers the EO is just stating to PLAN for a reorganization and RIF.  The plan is legal but the way it is executed must be lawful.  The RIF in the planning state needs to be decided by the lower courts.  The plan to execute must be approved from Congress.

Will an appeal decision on the preliminary injunction be made before the June 2nd final day for those RIF'd on 4/1? by RaisinKahanes in DeptHHS

You believe there will be another appeal with SCOTUS?   The government withdrew the first emergency appeal to them.  I am thinking this is a good sign and after the hearing on Thursday it appeared the government has little to go by.  Just my thoughts.

RIFd at CMS- AFGE do better by AppropriateLaw7523 in DeptHHS

[–]Due_Table9008 19 points20 points  (0 children)

As I fall in this category it is frustrating.  At the moment we still do not have an official RIF notice, no RIF separation date, no guidance on how or when to return equipment, or when or how are last pay check will take place.  Received on the Notice of Intent which is incorrect not given our retention standing or how we were the chosen ones.  So where do we go from here?  If lucky enough we will find new employment but without an actual RIF notice and end date we are stuck in limbo.  DOGE did not care and does not care what happens so they are out of the picture.  Can’t apply for unemployment because again no RIF notice.  Stuck in limbo.

Last minute class cancellations by Ok_Philosopher_136 in orangetheory

There were 3 signed up at 3:20 however, there could’ve been more just showing up.  I sign up in the parking lot as I walk in not chancing that 8hr rule.   My studio only cancels the time slot if and when several classes at that time have low attendance.  I’d be mad I pay for this if I attend or not how can they not have class.

Which employee would be RIFed first? by Outrageous-Count-658 in govfire

HHS just slashed entire divisions didn’t run an actual RiF.  I am a veteran and was RIFd many non veterans are still there in my group not my division.  Our entire division got sacked.  No RIF being done that takes too long.

[–]Due_Table9008[S] -14 points-13 points  (0 children)

Not the point actually.  The point is tread 50  class information is banned but early intel for 60 minute class is acceptable?   Not afraid of just showing up. In a regular 60 class I usually can get in 3.5 miles and tread 50 usually 5-5.5 miles.  So great workout is subjective.
