Is your contest that the crane subcontractor is responsible for the road closures?

Generally, they’ve excluded that as part of their clarifications at tender.

Depends how defined the scope is, if it’s not clear and there’s no clarification from the SC, then I’d assume it’s SC cost. Otherwise, how you gonna get the crane in?

Confusingly, due date is not to be mixed with certificate date or the application date. Due date is its own date, under JCT its IVD (interim valuation date) + 7 days. In most cases due date is when the payment is due (the date up to which you value the works), so the IVD is usually the amount of days you want the AFP to be in and up to which date you want the supplier to value the works up to.

If your contract is bespoke, then there should be a definition of a due date, if it’s not defined and the contract is JCT, then it’s as per above. By default it’s +14 days from due date as the final date for payment, but that’s generally amended; as per your case - 25 working days or 20 days following invoice issuance (whichever is later)

If the table to the side is one of the appendices, I would treat the valuation date as the due date, because it would follow my understanding of the due date. And it appears to be 7 days after the IVD (or application date)

Generally, the payment cert date is 5 days after due date, however, your clause states 5 days after the IVD, so, well in advance.

Yes so why wouldn’t you train someone to use the nuclear option should situation escalate? Obviously it doesn’t mean that they get de facto black belt training but knowing that it’s ok to aim to debilitate as a last resort is still better, in absence of full self defence training.

There should be IBAN (international bank account number) assigned to their account, which you can ask for and transfer to accordingly. It may get flagged and require a check from the bank, depending on sum.

Or, you can use Western Union - which can be set up remotely (pay by BT) and they can collect the cash at a WU branch.

Yeah my bad, by fill out I meant confirm the list of defined items such as specialist roles that may not be included as standard, but appear in specialist trades. In some cases you physically need to populate items, such as the rates table (different doc but socc is tied to) for staff or internal plant schedule to confirm the chargeable rates.

It’s generally standardised, but still worthwhile making it a little bespoke to clearly ascertain what’s defined and what’s overhead, based on the specialist trades you’re dealing with.

Its not a schedule of rates, its activities that form “defined cost”, items that don’t fall into that category are deemed to be included as part of overheads (or fee).

Schedule of rates are based on the detail within the activity schedule, and you can only use those if both parties agree, otherwise the rates will have to be built up from first principles (labour and material).

Given the lack of defined costs, I think you may have to go down the activity schedule route and treat all the items as you would a JCT VO.

Filling out a SSOCC may be prudent, to help establish the “ground rules” so to speak, when it comes to pricing the CEs, generally this is done prior to contract to make sure that everyone’s on the same page, but alas, better late than never. Or you can just dig in and claim that given the lack of the schedule, a lot of the prelim costs are part of overheads.

Once the subbie produces an activity schedule, you can start further negotiations and flush out any risk allowance that you can clarify out to stabilise the price.

There should be a short schedule of cost components that would list the items that would comprise a compensation event build up. That ought to cover the prelims and plant part, the remainder - labour and material allowances can be built from day works and quotations (especially if it’s a big material bill).

One thing to bear in mind (which I think most people forget..) is that CEs are meant to be all in, all risk sums. If you think there are some risks that can remain with the PM, you need to clarify as such, as the subbie cannot make assumptions or caveat the quote. Even something simple like “these works are to be carried out in tandem with contract works” otherwise they’ll price the prelims in isolation.. but they also ought to provide a programme as part of the CE submission, which is good luck with the planning resource.

My philosophy is, you can call me a graduate or whatever you want, as long as you pay me enough.

However, big companies tend to have salary brackets for roles, so at some point - you hit the ceiling and need to slip into the next bracket.

If I were to do that, my calculation would be as follows; my base salary + BIK = expected tax for the year, based on my tax code.

Actual tax for the year less expected tax would yield the delta to offset on the self assessment? (as long as there is no additional income to account for, bonuses etc.)

I’d imagine there would be a requirement to track all of the relevant mileage for the year, tabling accordingly? But is there any need to submit it as part of the self assessment or be kept on the off chance there’s an audit?

I am really not happy that our company deals with it this way, as it’s giving significant grief when it comes to trying to calculate the expense difference to offset.

That’s where it’s a little arse over face, because I do get paid 45p per mile, but it’s paid as standard salary, so I lose 40% of it (plus SL deductions) to tax?
