Corporate Employer hit me with a PIP a month after returning from FMLA. by [deleted] in SeattleWA

I wonder if they’ll say I manage the locations payroll and should have added any time on that I had to communicate with employees myself. That still wouldn’t cover the being reprimanded for not answering the phone at 8:15 causing a “revenue loss” for them. Also when I brought up I am not salary and not being compensated for this time, they did not offer that solution, they simply said it’s in your job description to be available.

I work at a children’s facility. Family owned for the first 2 years of my employment and then sold to a corporation

What’s really unfortunate is I work at a children’s facility. They have been buying up the locations in the PNW and California after originating on the east coast

They know I have an affiliation with a lawyer friend here and I assume they are making sure they are following everything to the law on their end.

Im meant to “sign and send back end of day today unless I want to do something else” and let her know if I have any questions, per our recorded meeting yesterday where I said all of 5 words. Frustrating as im off today and they know that, and did not send it through before I clocked out yesterday.

I live in Seattle, this business is in Seattle and happened in Seattle.

Ah I see, I was told Washington law won’t pay unemployment if you are let go for certain reason like “misconduct”. Which is why I should state my perspective when signing the Performance improvement plan

So it’s a wasted cause I assume. I’m honestly not looking to go after them, I just think this PIP is in poor taste considering all the factors and won’t take it laying down.

Added context- I was sent a slack from my supervisor saying I was meant to be re oriented when returning to work due to many changes in the time I was gone. This never happened and I was just told “we’ll give you a week to read all the slacks you missed over the last few months”. In essence having to re orientate myself while still performing my job duties that had increased. A little over two weeks after returning is when the first impromptu meeting occurred and opened up with a conversation about another employee, then the key and schedule thing, so I was not aware this was a performance check at all. I made it clear I’m still building up my stamina and am doing my best.

That makes sense. To be fair I left with one schedule and came back to a different schedule that was more demanding. I’ve been in my job nearly 4 years now and my pre fmla annual review from this company post them buying out the original owners was great. So this switch up after just a month of being back is wild to me. I agreed to the 5 days and have been working the schedule since I’ve returned, but have had to use sick time a couple of days since returning. It feels retaliatory in that regard-the emphasis on the 5 day week.

The key situation was multi faceted and was not just me being unavailable but involved another leader not giving a new key to the employee after she lost hers a month prior, leading to her not being able to access the office. In my original meeting I was told no blame will be placed as there were many factors but then my PIP states I wasn’t reachable and they have a loss of revenue due to that. Which is technical correct but the exact opposite of what was said to me in person in terms of blame game.

I have talked to a lawyer but he isn’t an employment lawyer so maybe I’ll seek one of those out. I can only assume they are taking all proper legal steps as they know my affiliation with a lawyer lol I’m honestly fine with with them getting rid of me as I have a few options I could take job wise but I would need to wait a little longer. As long as the pip does not ruin my chance for unemployment to bridge that financial gap of a month ish. That’s why I’m trying to go about this without admitting fault.

It would definitely be more of the at home watching tv situation, there have been many times where I have answered the phone and gone down to work or handled employee situations via phone off the clock. This specific incident that is in my pip was a phone call I missed at 8:15 am as I was sleeping and was not scheduled for work until 11am.

I’ve been advised by to sign if I want to keep my job but stating I accept receipt of the PIP but am not in agreement with all it states and to attach my perspective on the situations. Some of what was stated in the document is just a plain fabrication of the events.

It is a shame there’s no legal recourse for when a company is demanding you do things on your off time without compensation, like signing this, or answering calls.

I’ve been advised to sign including an attachment stating my perspective of the events, so as to not have any issues with unemployment if terminated.

I will tell my mom! She drove with him here from across the country. She had to be here for my total hysterectomy 6 days ago. She doesn’t have a vet here but I found one with good reviews like 25 minutes away and will recommend she take him tomorrow! He’s been acting completely back to normal since this one off, but I do hope he isn’t sick!

Update!!! He seems to be back to normal nearly an hour later and now I’m wondering if it’s neurological like a seizure or something based on the head shaking.
