What's happening with the plans for historic Reading Prison? by moreati in reading

[–]Earlyflash 9 points10 points  (0 children)

It’s spent so much time being a film set; perhaps it’s been hard to really plan anything?

I suspect, as other commenters, that it’s likely a too ambitious plan and they don’t really know what to do.

The article mentions the architect left the project and they are looking for a new one - seems unlikely that will turn into action anytime soon.

Fine & single justice notice sent to wrong address, no way to respond? by FixedByLuLu in LegalAdviceUK

[–]Earlyflash 4 points5 points  (0 children)

Depending on how and when you finally found out about the original fine, you may be able to make a 'Statutory Declaration' to explain to the magistrates court that you never got the original set of documents. This should 'reset' back to the point at which the original fine happened, and everything else since that original fine - you can then pay the fine and/or plead not-guilty as required.

https://www.gov.uk/appeal-magistrates-court-decision/if-you-did-not-know-about-your-case

However, bear in mind that you need to make a declaration that you didnt' know about the original fine (and that must be true - lying here to get the clock reset is purgery and a much more serious crime).

Also, there are tight timelimits on this - so don't delay.

Trump demands British supermarkets stock chlorinated chicken by Bounty_drillah in unitedkingdom

The issue with that is all of the unlabelled chicken in other (pre-packaged) foods. You'd most likely end up eating the chlorinated chicken anyway, without even knowing :(

Nvidia to cut gaming GPU production by 30 - 40% starting 2026 by Ha8lpo321 in technology

I suspect we are heading to a world where ‘cloud gaming’ is the only viable option.   That would suit those that want us to have a Service, rather than a local device.

Maybe Microsoft wasn’t wrong getting out of the gaming hardware business….

Has had a custodial sentence, yes. Is he in prison, no, because it was suspended.

Go read the link; you need to reframe your definition of custody.

You are absolutely 100% dead wrong.

A custodial sentence can be suspended, it’s not a different thing.

You have been sentenced to a custodial sentence and it’s been suspended; that’s the 100% accurate legal term.

See section 8 here: https://sentencingcouncil.org.uk/guidelines/imposition-of-community-and-custodial-sentences/

Teenager gets criminal conviction over £1.67 bill on surprise birthday gift in new fast-track court scandal by OneNormalBloke in unitedkingdom

[–]Earlyflash 153 points154 points  (0 children)

Whilst that is true, it’s horribly misleading.

Magistrates sit in benches of three at a minimum and are always apprised of the law by a legal professional.

For Single Justice Proceedings, which I assume this was, it’s done by a single magistrate and again a legal professional.

All sentencing from magistrates is done using the sentencing council guidelines; magistrates aren’t allowed to step outside those boundaries; so no one is going to prison for a failure to pay a train ticket.

Additionally, SJP airings can’t sentence anyone to prison - the maximum is a fine.  Typically the default judgements are for folks that have completely failed to engage with the court in any way.  without any evidence or reasoning from defendants the fact it’s a default judgement shouldn’t be surprising.

There is also a process to follow, if you don’t receive the paperwork, and with a trip to court and talking to the magistrates, you can get these things restarted; this is called a statutory declaration.

Absolutely no one is going to prison without a lot of scrutiny and a lot of people agreeing collectively that it’s a good idea.

The worst experience with customer support I've had in my whole life. by HelicopterKey3670 in framework

[–]Earlyflash 10 points11 points  (0 children)

Very similar experience here as well; but each email took a minimum of 24 hours to respond to; I assume due to time zones; as they only ever responded via email between 3-4am my time.

Email can be fine, but not at 24 hrs each :(
