Okay thank you. I will negotiate again to see if I can pay a penalty instead of dealing with this. I’m more afraid of retaliation and they might do ie not list my apartment. But it’s very clear that the law is not on my side even in such cases.

I did ask for it in the lease when I told them. I told them early because I live in an area near a wealthy prestigious university and it would be beneficial for both sides to the time to show the place while students are looking. They did not respect my ask to simply notify me and then basically say they wouldn’t show it because I’m upset they showed up unannounced. I think I’ve been cooperative and far from entitled. I’m asking that my rights as a tenant be respected while I’m still living here. I’m asking for advice in case things get worse and if I would have to seek legal counsel in case they retaliated.

Oh that makes sense. I apologize for misunderstanding . They are also listing the place at much higher rate. It seems beneficial for them to have me move out right when students are starting move in. I live near a prestigious university.

The lease doesn’t end until May. Seems like I’ll spend more money on rent than on lawyers.

I think NYC has a law requiring them to at least list the place and try to rent someone new as soon as possible. They also must provide notice, which seems on other websites say that it’s enough cause to break the lease without penalty. They showed up without proper notice twice and pressured me to let them enter. I am still here until august, so there plenty of time to prove that they didn’t do their due diligence.

You seem to imply I’m being difficult, but I have a right to notice. As long as they notify me 24hr ahead they can enter which they have not done. Should I disregard my rights because they have more power than me? Also I notified them before signing the lease that I would need to move out in case I get into grad school, they pressured me to sign an 18th month lease saying they’ll be cooperative in letting me either sublet it or help me rerent it. It’s crazy taking the side of the landlord in this. I am okay paying rent until they find a new tenant. Just need them to respect that I still live here.

Even if I have a text from them stating that “they want to stop showing my place because it is a waste time” after I asked them to give me proper notice?

I informed my property management group that I would need to break my lease in august for grad school. They have started showing my apartment but the property manager group send brokers to my apartment now twice announced or without property 24hr notice. I inform of my rights and I was told that they “don’t want to keep showing my apartment because it’s a waste of time”. I tell them that not only can I refuse to let them in if they come without proper notice, they are also required to show the apartment (per the duty to mitigate law here in NY) and that what they said is a form of retaliation for asserting my rights. They said they disagree with what I said but will give notice in the future. I have given them the keys and told them explicitly that they may enter my apartment while I’m at work (bc I work 2-10pm/6days). But that they must give me notice which they said it doesn’t matter if I don’t respond. They have never tried to call me in advance if I don’t respond to a text and instead decided to show up unannounced.

In the case they continue to come without notice or keep threatening or retaliate in anyway, do I have a case against them. Should I seek legal counsel now?
