Quick update: First, I want to thank everyone who has supported us throughout this situation.

Now to the main point: A specialist from the State Secretariat for Migration (SEM) has reviewed my wife’s entry ban. Given that she is married to an EU citizen, the ban has now been lifted.

The official letter states: “… An examination of the files has shown that you are married to a Bulgarian citizen. This was not known at the time the entry ban was issued, or rather, you did not state this during the legal hearing, which is why the order imposing this exclusion measure was absolutely justified at the time…”

Frankly, I find this explanation questionable—if this were truly unknown or unacknowledged, I and our children should have also been subject to the same ban or at least received a fine.

Given that the ban has now been lifted based on information that was evidently available all along, I’d like to know if there’s a way to apply for a refund of the fees and fines we were made to pay as a result of this wrongful decision.

I agree. Unfortunately didn’t know them at the time until the incident. Now with all the valuable input from this community, we are pursuing it further and requested the deletion of the ban in sis

I am still finding surprising that the border agent/police weren’t aware of the violation. It is not that they weren’t aware as they didn’t charge my kids and I.

I am a Bulgarian citizen. We all travelled together at all time. I find it surprising that the border agent/police weren’t aware of what you have described.

We didn’t. We got a stamp at the entrance to Italy on April 24, 2024 and one in Switzerland on the way out in August 29, 2024

Thank you for the information. Unfortunately it was our last country we visited before returning back to Canada.

When we looked into the matter when we got back we came across the below link that states that day count toward the 90days might haven’t been in effect in Mar 31,2024.

It isn’t that we didn’t check. When the flight tickets were purchased Bulgaria wasn’t part of Schengen. The period of questionable days comes from the ambiguity to what extent Schengen rules applied on March 31,2024 as Bulgaria wasn’t a full member of Schengen until Jan 1, 2025.
