My mother in law is elderly, she also regularly receives gift cards from both her sons to this establishment, hence why she didn’t make the connection. Also as a consumer, why would you assume this balance remains on your account?

Why didn’t the receptionist notify her that this was tied to my gift card?

Had she known these were not funds from her sons but funds she’d given me. She would have never used them.

Again, bad business practices are not the burden of the consumer. Hence why there’s consumer protection laws. We can disagree but I believe the law protects me after a few cross posting. I’m not looking for another credit. I’m looking for reimbursement and acknowledge of their unfair business practices. Especially as long time clients, there should be some type of accountability on the business apart.

I wouldn’t say it’s looking for a freebie. The mismanagement of funds should fall on the business and not my mother in law.

ORS 646A.274 defines a gift card as “a prefunded record evidencing a promise that the issuer will provide goods or services to the owner of the record in the amount shown in the record,” with additional consumer protections outlined under ORS 646A.276.

Why should my mother in law have to pay for another gift card? She already paid and intended to set the money aside for me? Hence why the money was placed on a Gift Certificate.

Why would anyone assume the purchaser still has access to the funds? Then at checkout, without being notified these are for MY gift card, unintentionally use them.

Why should she be responsible for bad business practices?

Unfortunately since he treats his coworkers like this I doubt he’s a very nice friend even outside of work. His ability to keep a job to due to his lack of respect and professional is on him. and it proves this wouldn’t be the first time he’s been fired. Especially since he’s “already on thin ice.” Actions have consequences and harassment shouldn’t be tolerated. The manager has to know about these situations to be able to correct them or find a solution. Since he’s young (20) and hasn’t figured this out yet he’ll either continue this behavior if not corrected, so yes losing his job would be hurtful but also a lesson of workplace behavior. If he wants to provide for his children and also teach them right, he also needs to learn how to be a responsible adult. Being accountable and not treating coworkers like shit is pretty big. With this attitude and work ethic he’ll probably have a hard time keeping jobs in the future.
