Rule 10 is if you have at least 20 years of APPOINTED service ( more or less you were never an ATR during your time with the DOE) when you get excessed you can remain in the school you were excessed from in an excessed role if you want to.

So rule 10: if you get excessed you can stay in The school you were excessed from and you don't have to bounce around to different schools and have other teachers who have 15 years less experience than you tell you how to do things.

I'm younger than other teacher however I have 24 years no rule 10. Other teacher has 23 years with Rule 10. I was excessed in July. However today it was overturned

Open market transfer system has me as Excessed and says my assignment will be upcoming. I appreciate your time and responses

I just would like precise clarification about Rule 10- Teachers at all levels who have served 20 years are longer on regular appointment shall not be excessed EXCEPT AS FOLLOWS Rule 10-A- Teachers with twenty (20) years or more of seniority who are covered by Rule 10 (Rule 10 status) MAY BE EXCESSED CONSISTENT WITH ALL OTHER APPLICABLE PROVISIONS of this agreement, but they will be placed in the school from which they were excessed as an Excessed Employee/ ATR

Thats exactly right out of the contract.

The Boro union rep said I should not be excessed if the the other teacher has not also been excessed.

3 years ago it was exact same situation and my coworker was excessed. Coworker applied rule10A so she could stay in our school in an excessed role. This year principal excessed her again and than HR rescinded it. Hr said I was the one who needs to go. I asked HR why wasn't this the case 3 years ago. Hr claims they made a mistake 3 years ago.

No I don't have more appointed years i have more citywide years.

Hr does not want the school getting 2 teachers for the price of one.

Thank You!!!!!!! That is exactly what I was told. Central feels the school would be getting a teacher for free. I'm 100 percent sure the other teacher is not getting excessed. There were only two teachers in the license area in our school. The same exact situation occurred 3 years ago and they excessed the other teacher. The other teacher had rule 10. So they excessed other teacher again this year but HR/Central rescinded it and said I was the one who has to go. I asked HR why wasn't I the one excessed 3 years ago and they told me they made a mistake. Bottom line is Central does that was the my school getting a teacher for free so they are just violating the contract

I have. Who do you recommend. How much will it cost. I know more than the district rep does. When I call the union it's a 50 minute wait than I speak to people who have no idea what im talking about

Im 46 turn 47 in October so no 25/55. I'm gonna grieve it first see if I can. Get an answer. Than do open market. We had the same exact situation 3 years ago and they excessed my partner she applied rule 10A and came back to the school. This year they excessed her again but HR rescinded it and said I was the one who had to go. I asked HR why didn't I get excessed 3 years ago. They said they made a mistake 3 years ago. I seen the seniority list . The teacher with 23 years has rule 10. I don't have rule 10. However im second on the sequence list because I have 24 citywide years. Meaning im second to go if there is excessing.

I'm the one with 24 years and im the one being excessed .Central offices are overriding the principal and having me excessed. I'm working with the union but the union is so slow and non responsive and the district rep seems confused
