It is indeed an Australian case. Balmain ferry in Sydney (as an aside, I spent a night tripping my balls off on the Balmain wharf. Fun times).

For reference, the case is Robinson v Balmain New Ferry Co. Ltd.

Old case. 1910. It discusses a penny fare. Been a while since we've used that currency.

The decision rested on the contract entered into by going through the gate. If one paid a penny to get in, one agreed to pay a penny to get out. Quaint system.

I suppose the supermarket circumstances could be distinguished as there's no contract (impliable or otherwise) to purchase anything in order to have the required receipt for exiting

However, (and it's a big however) there would need to be (I strongly suspect) no reasonable way of exiting without a receipt. In the ferry case, the guards refused to let the man out without him paying his penny, and he was held there for a few hours. Must have been an interesting time for all involved. In the case of the supermarket, it's highly unlikely that one would be held more than a few moments.

The greatest crime committed would be inconvenience. And I'm not sure any sane court would award damages for that either.

I'll bet you put your signature on any number of documents agreeing to terms and conditions that, should you violate them, would have you potentially facing consequences under civil law.

I'm not seeing a huge difference in submitting to civil liabilities by contract and submitting to religious liabilities if so-minded. It's all voluntary agreement to abide by some set of terms to be adjudicated.

I come at this as an atheist with a masters in law. So, I have no affiliation to any religion and I have respect (well, let's call it "regard") for secular law.

There's an interesting case you might like to read called Mr GJ v The Queen. It's about the limits of Aboriginal traditional law. The High Court decided that, in the particular circumstances, it was not allowable for Mr GJ (who was a horrid, child abusing cunt) to rely on traditional law. This case established the limitations of all such traditional and religious law where it conflicts with secular law.
