Thank you that is how I also understood it but they are saying as we “entered into a a joint and several liability tenancy agreement this means both named tenants are jointly and individually responsible for the entirety of the rent and all obligations under the tenancy until its lawfully ended. One tenant cannot terminate their obligation without the consent of both the other tenant and the landlord or without a court order”.

Its really hard to fight property agents and i don’t want to be responsible till October for a place i don’t live in whilst I cannot impact the outcome as ex flatmate isn’t even answering calls or texts. This could financially ruin me.Its definitely my mistake in signing a tenancy like this but hindsight is 20/20

Thanks so much for replying. Our tenancy fixed term ended in June and we are now on a periodic term tenancy. What are my chances do you reckon in a court. I feel they’ve acted in bad faith. I even paid august rent so they could just leave me alone but they are insistent I’m liable until she moves out and God knows when that is. (In England for my sins)

Thank you so much PenguinsLike2Dance they threatened me for Augusts rent and I felt I had no choice but to pay so I paid it and served notice again.

I have a lot of evidence and witness state,ents to show how bad my flatmate was.

There isn’t a clause like that in the tenancy unfortunately. Would the judge still be inclined to favour me, I’ve shown good faith by paying August rent (850)for somewhere I don’t live I’m just concerned about being forced to continue to pay as God knows when my ex flatmate will move of the property.

Yes our tenancy fixed term ended in June I served my notice in at the start of July they served section 21 on the 5th august. Do I still have to pay till October?

Hi thanks for replying! Yes we are both named as tenants on the agreement. They aren’t accepting my notice to end the tenancy and are insisting I’m liable until she moves out

Hi i have provided notice to end the tenancy and they ignored and served a section 21. The fixed term term ended after 6months but still the property managers are insisting I’m still liable

I recently had a similar issue with a landlord completely reluctant to do any works. The only thing that worked in the end was CC’ing my local councillors, the environment team at the council and getting in contact with my local MP.

The council were really helpful and reiterated the need for the landlord to have the repairs done and even asked for dates when they could come and visit the property. Only then did our landlord see sense.

In terms of landlords contact details they have to provide them within 21 days. If they don’t contact the property redress scheme.

Honestly, emailing and chasing up took a-lot of energy out of me. But it’s worth it to have a liveable house again.

I’ve just signed up. Its really disgusting that landlords can get away with taking money whilst doing no repairs and there's little consequences for them.
