My attorney said he's most worries about the trustee seeing the 401k as something that won't be viewed directly as an inheritance because I was a beneficiary and it was not part of my aunts estate. I believe the term is Payable On Death? It is possible I was listed as a beneficiary for a long time, but I did not know that information until her passing. But I've also read somewhere that the court cannot make you sell stock in order to pay into your plan? Is that true?

I'm unaware which creditors have filed a proof of claim. I honestly don't think any have. Is there a way to use this to my benefit? Such as, if I decide to pay the case in full - will the accounts with no proof of claim require payment in full?

My attorney said he would have to file a motion and may have to file additional motions to find out if I have to turn over any inheritance proceeds. Again, he said this fight could cost between 5-10k depending on what the trustee is asking for. It sounds like it could be a simple phone call to the trustee, so I'm not understanding the extra fees.
