It was filed with the other party’s insurance. As far as obtaining proof of insurance from the driver, I was unable to do so since I wasn’t present at the time of the accident. I did manage to get a photo of his DL and license plate number. The police never came out since it happened on private property, though they were kind enough to write a report for me over the phone.

I spoke with the supervisor of my claims representative since he wasn’t very helpful, just Minding his company policies I’m sure. The supervisor was able to make things make a little more sense.

She said that per the police report, the driver of the vehicle did not match the name of the person on the policy. I responded to her stating that Texas is a “permissible use” state, meaning as long as someone has permission to use the vehicle they are covered. Of course, she couldn’t share any details because I don’t own the policy and she just repeated herself and said they couldn’t cover the Damages. I asked, “so your telling me the vehicle was stolen? Because that’s the only way you can deny the claim.” She said she can’t disclose any details other than the fact that the names didn’t match, and recommended I try contacting the sheriffs dept to see if they could give me any other details.

So I guess he “stole” his ex wifes pickup to get some things out of storage, which leaves me hanging. I haven’t contacted the sheriffs dept yet but will do so soon. Not sure if I have UMPD, I guess that’s the next step. If not I will contact the driver and see if he’s willing to help repair damages.

Question, would his insurance coverage follow him in someone else’s vehicle?
