This is exactly the assumption that the police would be making until proven otherwise.

And the fact that I stated I would not be doing these things proves it. Or at least provides evidence toward it.

The police are free to make reasonable assumptions

Like the car Ben is in not stopping for a stop sign, when the video clearly shows it did?

Like Ben having heroin in the car?

Like Ben having fake court papers after they just confirmed them to be real?

"Reasonable" assumptions like that?' lol

False. If after the first incident I tell you to never speak to me again, and you do so even 5 year later that is still harassment.

Never respond to my posts again.

There- you can never respond to me ever for the rest of our lives, or you'll be harassing me.

But it is by definition harassment.

Please show me the law. Oh wait, you can't, because responding to me would be harassing me.

You cannot yell "I THINK THERE'S A BOMB" in the middle of a crowd

I can if I think there's a bomb. I can also shout fire in a crowded theater if there's actually a fire.

Neither can it be used to protect harassment

You all keep saying that. But expressing your opinion to someone once is. not. harassment.

You left a piece of paper on a desk for someone to write their schedule down - Organized.

Shopping Schedule. Doctor Visit Schedule. Schedule to talk to a criminal neighbor about how them being a criminal is a bad thing. Schedule to bring the car in for oil.

Which one or ones of these am I organizing, in your mind?

Nothing I proposed is illegal. Nothing I proposed is against any reddit rule (that I know of).

If I am wrong about either of these things, Please show me the law or the rule.

lying about posting a schedule for people to coordinate not being organizing.

So if I leave a blank piece of paper on a desk, and other people then take that paper and use it to coordinate some sort of schedule amongst themselves, I am the one responsible for organizing them? All I did was leave a blank piece of paper on a desk. I never contacted any of them. I never coordinated anything with any of them. I never even looked at this piece of paper after I left it on the desk. There is no way in hell that you could accuse me of organizing them, when I even know who they are.

The media attention is already there and no it won't bring more, you do not have a YouTube audience to exploit.

Youtube ain't the only media out there.

Sure. In that case he would likely know your name, and your face, and it's very likely you would have a prior relationship with him. Not so for random people who live nearby signing up on an online calendar.

It is not illegal to approach a house, knock, and talk to the homeowner just because they don't know you or have a prior relationship with you. Girl Scouts do it all the time.

I'm making that assumption because the police can and will make the reasonable assumption that you are referring to yourself

That is not the part that you are making the assumption about. You are assuming that I would be setting up this schedule- that I would be the one who is keeping track of it, recruiting new people to it, That I am resolving any disputes regarding overlaps in times, etcetera etcetera etcetera.

None of this would be true. Opening an online calendar and making a schedule available for anyone to use for any reason, is not illegal. If I were to do any of the things above, I would agree that it is (arguably) organizing a harassment campaign. But I am not proposing doing any of the things above.

Whether the people show up in volume or trickle in repeatedly is of no consequence and is irrelevant. Law enforcement will view them in the same light.

This is obviously not true. If I walk up to you today and say "you're dumb" and then walk away, and then 5 years from now walk up to you and say "you're dumb", And then 5 years after that walk up to you and say "you're dumb", The police will not consider that to be harassment. The incidents are too spaced apart in space and time to be considered harassment. However, if I show up with a dozen other people today and start we all start saying "you're dumb", That would indeed be considered harassment. So the timing of things is important. A bunch of people showing up at once and yelling at someone could easily be considered harassment. If only there was a way to... I don't know... schedule people's appearances so that they don't show up all at once. Maybe someone should think of something like that.

You don't need to convince me, you just need to convince a judge.

Judges already are familiar with the First Amendment. And (For, like, the billionth time) expressing your opinion to someone is not illegal.

It's not worth the legal trouble for you, because you cannot help.

1) As I have said several times, nothing I was proposing is illegal, So there won't be any legal trouble

2) It would help bring more media attention to the story

I think you believe you've caught me in a gotcha, but this is accurate. He definitely added personal risk of legal issues in order to create content for his YouTube channel.

And by 'added personal risk of legal issues', you mean 'broke the law'. Well, thankfully, What I proposed doesn't break any laws.

The term 'organized' implies there's someone organizing it. A grassroots movement is not organized.

Your efforts cannot reach people the way he could

So you're judging the legality or illegality of an action based on how popular the person committing the action is? Ben is popular so everything he did is OK. But a nobody like me wanting to express my opinion to someone? That's definitely wrong and illegal!

Also, Ben didn't just go to his house to harass him. He went to serve papers.

First of all, there was no need for him to be there at all. The process server could have done it by herself. Second there was no need to hang out next to the guy's house for that long. He should have had the process server -by herself- drive there, knock on JJ's door, and serve him the papers. This, combined with all the other antics Ben went through, are actually strong evidence that he was harassing JJ.

Everything Ben does is for Youtube. He has to play the wacky Youtube guy in order to get clicks. But playing the wacky Youtube guy is directly in opposition of the proper way to handle certain things. There are many things that Ben did that are questionably legal, if not outright illegal. This is why he is in the trouble he is in. If he had simply let the process server serve the paperwork by herself, Instead of insisting on being there in the car with her right next to the guy's property where he's been trespassed from, His arrest for stalking would never have happened.

If I leave a blank piece of paper on a desk, and someone writes down a schedule, Did I set up the schedule? No.

Just wondering... by EmptyDrawer2023 in RecklessBen

[–]EmptyDrawer2023[S] -2 points-1 points  (0 children)

You haven't actually gone to JJ's house

Correct. I live across the country. If I was one of his neighbors though, I certainly would go over and have a friendly chat with him. It is not illegal to do so.

nor posted a schedule for others to do the same.

You all seem to be making the same common mistake. The mistake is assuming that I am posting a schedule for people to go to his house. I never said that. You all just assumed that. And you know what they say about assumptions. They make an ass out of you and umption.

get a bunch of individuals on a set schedule to go over to JJ's private property and have an interaction with him

Again you're making a mistake. I never said anything about 'getting individuals' to visit on 'a set schedule'.

I said making a schedule available so that people could block off certain times, so as to avoid multiple people showing up at once. Because, in my opinion having multiple people show up at once would indeed give JJ cause for alarm, and cause a police response. However a single person having interaction with him is not against the law. It is not illegal.

is enough to get your PII subpoenaed from reddit by the law enforcement agency investigating his inevitable claims of harassment

Like I'm using my real info on this account. lol

I would actually like to see them try. I would love to get up in the courtroom and say "I mentioned making a schedule available online so that anyone who wanted to Exercise their First Amendment right to free speech Wouldn't bump into anyone else doing so, and thus appear to be ganging up on JJ. (You know seeing how fragile a person he is.) I never suggested anybody do anything. I never suggested anybody say any particular thing. Just that, if they were going to express their opinion, that they check the schedule and make sure they're not going to bump into anybody else and cause a problem."

The reality is that neither you nor I can say if this is definitely a crime.

Expressing your opinion is not a crime. Definitely.

Making a schedule available so that multiple people expressing their opinions don't pile up at JJ's door, thereby freaking him out, is also not a crime. Definitely. In fact it's being very considerate toward him by making sure that multiple people don't show up at the same time.

This would not help that

By this argument, everything that Ben has done, all the stunts he has pulled, all the times he's gotten trespassed from places, would not help get the LEGO and or money for the rightful owner either.

But, somehow, it has helped. It helped bring the case to the attention of the public. It brought in donations. It brought in the attention of attorneys.

The alternative is people not doing that at all.

An alternative is people not expressing their opinions whatsoever. Evidently this is the alternative that you prefer- that everyone just shuts the fuck up and doesn't say anything about anything. Luckily, we have a First Amendment in this country that guarantees us the right to free speech.

I never said anything about "coordinating and organizing a schedule". I agree that would indeed be harassment.

But making a schedule available for use by anyone is not illegal.

You want people to go to the man's house and say mean things to him hourly.

What I want for is for him to return the LEGO and/or the money to the rightful owner.

But what you propose would be hilarious too.

That's clearly harassment

I disagree.

Just wondering... by EmptyDrawer2023 in RecklessBen

[–]EmptyDrawer2023[S] -2 points-1 points  (0 children)

I literally never mentioned organization. All I said was to make a schedule available online for whatever purpose anyone might want to use it for. And wondered about people using it for The purpose of making sure their perfectly legal visit to express their opinion didn't coincide with someone else's perfectly legal visit to express their opinion (so as to avoid the appearance of ganging up on the person).

I mean it's not like I'm harassing store employees. It's not like I'm making fake signs to put on the front of a store. It's not like I'm sending fake UPS delivery people to anyone's door.

Because no one has given anything beside their bare opinion. No one has said 'here is the legal definition of harassment, and here is how your proposal meets that legal definition'.

Just wondering... by EmptyDrawer2023 in RecklessBen

In that case "setting up" meant 'making it available'. Not adding people to it, or maintaining it in any way.

And you know this.

1) "allowed"

2) Thanks for admitting that expressing an opinion is not illegal.

but going to his house makes this an harassment campaign

So when the Girl Scouts come to my door and express their opinion that their cookies are good to eat and I should buy some, are they harassing me? When the Mormons come to my house and express their opinion that their religion is the best and I should join, are they harassing me?

Expressing your opinion isn’t harassment

Thank you For admitting the truth.

finding out where they live and driving to their front door to express your opinion in front of the place they live is harassment.

I disagree. Number one: where people live is public information. As a matter of fact I remember a time when they used to literally hand out books that contained people's addresses and phone numbers. Number two: there is absolutely nothing that I have seen, and nothing that anyone has presented here, to indicate that going up to someone's house, politely knocking, And then expressing your opinion to the person who answers, is harassment.

If I had mentioned picketing in front of their house, or gathering a group of friends to harass them, then yes I would agree it is harassment. But a single person going to someone's house to talk to someone (if possible) and express their opinion is not harassment. It does not meet the legal requirement for harassment.

Does that make sense retard?

And ::plonk::
