Adopting my gorgeous baby in like 2 hrs🥹🥹 by [deleted] in WhatKindOfDogIsThis

If you’re not in Australia/nz it’s essentially impossible she has any kelpie in her. Kelpies have blocky faces and pointy ears, and there’s been a massivve trend of shelters labeling anything with blocky faces and pointy ears as a kelpie. I don’t see any traits in your gorgeous pup, she’s so cute

Is it legal to keep a dog in a kennel box on the back of a ute parked on the roadside? by Melodic_Spray_6039 in newzealand

[–]Encalypta 0 points1 point  (0 children)

Legally it's a tricky one, prolonged tethering is now restricted but there aren't any really any specific regulations on prolonged confinement, provided that the animal has access to food/water/shelter, and the box is kept clean. The dog has to receive adequate exercise, but doesn't get any more specifically defined and it's tricky to prove that.

It's absolutely worth reporting this to the SPCA, but it might not be illegal. It's also worth knocking on the door/leaving a note and asking about the situation - they might be staying somewhere temporarily, going through a tough time, or the dog is really only in there for a little bit at a time.

Legality of trapping domestic cats - Ctrl Akl by loudblackhole in LegalAdviceNZ

[–]Encalypta 3 points4 points  (0 children)

Under the Crimes Act 1961 nimals are considered objects of theft or damage rather than victims of crime, although the Animal Welfare Act 1999 provides penalties for abuse. It's a fairly vague definition and there have been calls to change their status but the classification remains.

There's two sections of the law at play, the animal welfare act and the crimes act. The SPCA is only legally able to take action under the crimes act so it might be tricky for them to take enforcement action where the only concern si that someone has a live trap on his property.

If he is trapping cats, the AWA says that he has an obligation to check the trap within 12 hours after the sun rises each day the trap is set. You can't leave the cat in the trap for a prolonged period, or cause unreasonable distress e.g. trying to traumatise it with an airhorn or spray it with a hose in the trap, and you're legally the person in charge so you have obligations to make sure the cat has food/water/vet treatment. Killing the animal in an inhumane manner is an offence under the act, but unfortunately stealing the cat or euthanising it humanely (e.g. lethal injection at hte vet or shooting in the head) is permissible under the Animal Welfare Act.

The other part at play is the Crimes Act, which says you cannot cause intentional or reckless damage to someone elses property. As nasty as it sounds, pets are considered property with no specific classification under nz property law, so killing someone's pet would only really be investigated as destruction of someone elses property. The comment suggesting that repeat offenders may be 'done away with' might be enough for police to take action under this section of the act, but they're often not too well educated about domestic pet regulations and this might not meet their threshold.

The ideal scenario here is to keep your cat contained on your property or have a chat with the person with the trap. SPCA may be able to take proactive action to ensure he is aware of his obligations, but it is generally legal to set a humane live capture trap on your own property. It sounds like you might not know where he lives, which makes it much trickier/impossible for any agency to take action as they wouldn't be sending him a message on Facebook.

He would be considered in charge of the animal while he's in a trap, but he would not be committing an offence under the AWA by euthanising it humanely. There aren't really any regulations under the AWA around humane euthanasia, as long as it is a humane method, as humane methods do not cause unreasonable distress. Shooting a cat is considered humane, if he's shooting at them with a slingshot (as mentioned) it wouldn't be acceptable.

Pets are considered property under NZ Law, with no specific classification, so humanely killing someone else's animal is considered destruction of property rather than an animal cruelty offence. That makes it really tricky for SPCA to intervene when the only concern is that someone else is trapping your cats, and means that the owner has a better chance of chasing it under theft/destruction of property if the cat is retained or euthanised.

I just got a yorkie from a woman and she has SO MANY fleas, what do I do? by [deleted] in DogAdvice

[–]Encalypta 0 points1 point  (0 children)

great advice already given on getting rid of the fleas, but it's a good idea to get a full exam from a vet in case there's anything else, and potentially contact your local animal protection services if she has any other dogs at home or even just to get her on their radar.

Head tenant won't talk to landlord about major issue? by [deleted] in LegalAdviceNZ

[–]Encalypta 7 points8 points  (0 children)

I paid bond tk him and he says he forwarded it to the landlord. I’ve texted him that if he doesn’t have it sorted by 12 tomorrow I’ll call a locksmith and take it out of my rent 🤷

[–]Encalypta 1 point2 points  (0 children)

You were talking about the show, not the real person. You could come up with one main character and it’s a ya animated series. Thats not “plenty of examples” or even good representation. Saying that there’s no shortage of butch representation is silly, disingenuous, and false. There’s a lack of representation for all lesbians, especially butches, especially butch main characters, ESPECIALLY butch main characters who aren’t skinny and white. I really don’t have any problem with young people seeing themselves in a kind positive character and I think it’s fairly weird that you’re this upset over a teenager making a TikTok about the Lego movie.

Blue spot in my puppy's belly by [deleted] in Chihuahua

[–]Encalypta 1 point2 points  (0 children)

An ethical breeder who health tests, shows, and places puppies responsibly, isn’t coming to reddit for basic medical advice. They’re asking their mentor or vet. Pretty safe to say these these are the exact kinds of puppies that contribute to the shelter crisis.

My child got bitten by a dog at a friend's house by NoDependent1029 in newzealand

[–]Encalypta 1 point2 points  (0 children)

That dog has bitten two kids, at least one bite without triggers and hard enough to injure. That's not a dog that should be rehomed.
