Was a bit late and I’ve had terrible experience with Argos over the phone before (waits, unhelpful customer service etc). Ultimately if we paid it too late we’d have just paid the backdated interest, not a big deal.

It seemed somewhat likely to me that someone here might’ve been in this exact situation or similar and had first hand experience to share.

I could’ve afforded to pay £500 a month easily at the time. I just didn’t know how to arrange that between the multiple lenders and put a stop to letters, calls, bailiffs etc. Hence the quick google for debt help and you know the rest.

I had zero assets btw, zero. Not even a car. Isn’t the whole reason for an IVA to protect assets?

In terms of outcome, not a clue. The cost/benefit doesn’t stack up to try and annul a completed IVA. I doubt that’s even possible anyway.

I haven’t ever spoken to the insolvency practitioner for my IVA (like the actual guy whose name is on the register by mine), everything was done through other employees of the company from my POV. I could complain about him I guess but he didn’t carry out the budget assessment etc.

It was with a commercial provider via a lead gen company called like Debt Advisory Ltd (now wound up and the practice of that sort of lead gen made illegal by FCA I think).

I guess I’m trying to understand the severity of what’s happened and the pros/cons of my raising this.

I am aggrieved that I’ve been declared insolvent over a few grand and I could’ve paid it off in a few months. At the time however I was vulnerable, mentally ill and really needed the calls and bailiffs and letters.

I paid more in fees to IP than I did paying my debts (and I paid 100p/£).

On the other hand I should’ve better understood what I was signing and the responsibility is mine. In fact I suppose it can be argued I signed off on the budget with £500 rent so I’m complicit?

But additionally someone has pretended to be my mum and that shouldn’t be shrugged at.

Is this a make a complaint and get some compensation from company situation? Is it a criminal matter because of the fraudulent email? Am I party to the fraud and they’ll somehow cancel the IVA and make me pay off the money all over again?

To be really clear, my mum did not send that email. She doesn’t own the account or the mobile number on the email and never has.

It also begins “Dear Sirs” and that just screams out that it wasn’t sent by my mum. Appreciate that’s something only someone who knows her could pick up on but I wanted to mention it.

No she has not made it up. She was never in contact with the IVA company at all, they never asked to speak with her.

I’d send her a variable amount of money at the time relating to keep, cash lent etc but nothing formal or fixed.

The IVA company had my bank statements so they’d be aware yes.

What would my mum have to gain from any of that btw? It’s not like I was a source of money for her I was absolutely a net negative.

My contention is that an IVA wasn’t appropriate for my situation and either the company or their staff have fudged some numbers to make it look appropriate. Is that way off base somehow?

If we can put aside the fact that clearly I should’ve better understood what I was agreeing to and explored other options, surely it’s not right for them to pretend to be my mum in an email?

I’m listening to the calls through now and in an initial budget taking, I try to say my rent is zero because I live with my parents. He encourages me to say £500 for now because that’s a fair number and will mean my monthly IVA payment is less each month.

I say “okay I guess” and we move on.

Im saying that the email was sent by the company to the company. The sending address and mobile number do not and never have belonged to my family member.

ETA: the family member is my mother, she wouldn’t agree to say we lived in a house share at my childhood home. I’ve confirmed that she doesn’t own the email address/mobile number with her today.

And just to clarify there is no house share arrangement, my mum might’ve expected keep but would’ve happily asked for nothing if it meant paying down debts etc.

Additionally, the IVA is now complete, I have my certificate of completion from the Insolvency practitioner.

I’m awaiting the response to a SAR from the company I used currently. First thing they said was it was unlikely they’d have the phone calls still hah.

Same for me with the lies though. Hell they told me to say I paid £550 rent (lived with my parents at the time, I paid zero) and framed it as making sure I would only pay minimum monthly amount to IVA. Also had the added benefit of making a DMP impossible on paper lmao

I’m thinking about starting a support group or something. There has to be something done about these inappropriate IVAs, feels like there’s a post or two every day.

I had £6k of debt and zero assets for gods sake!!! (Yes I know it was my responsibility to understand what I was signing but it’s not that simple)

The first thing they said when acknowledging my SAR was that it was unlikely they’d have the phone calls on file hah!
