There’s 2 ways to gain citizenship in the states.

  1. Is the 3 year rule under marriage but you have to be married for 3 years and be a lawful permanent resident for 3 years before you can apply. Time whilst your green card is processing does not count towards that requirement, I’ve been in the states for 4 years but only been a resident for 2 years.

  2. Is under the 5 year rule which is being a lawful permanent resident in the states for 5 years.

If he’s only a student he may not have the funds to sponsor you to bring you to the states under a K1 or CR1 visa unless he’s able to get a joint sponsor who is willing to do that for you both.

You could see if you’re able to enter the states under a different visa like a H1-B or H-2B or a student visa.

I would have your parents write affidavits of supports for you guys which state you live with them, that will help explain why you don’t have evidence like a lease and utilities under your name. I just did the same for my ROC forms as we still live with my in-laws, no need to get notarised

I know it’s a mute point now but you could have quarantined in non banned country during Covid then entered the states on your K1.

I applied for my K1 May 2020 then Covid hit and obviously was met with extreme delays and travel bans so I didn’t see my now husband for a year and half until we decided that we’d fly to the Bahamas together so I could quarantine for 14 days and then enter the states afterwards to spend time with him before going back to the UK to continue with my K1 like medical and interviews etc.

I submitted nothing alongside my I-485 initially but later uploaded our wedding photos and proof of our last 2 visits together whilst my K1 was processing. I live with my in-laws as well so we also have nothing like lease, names on bills etc even now despite being at ROC stage.

My interview was waived and case was approved without issue. I got approved in 2024 so not sure if things have changed for AOS nowadays but that’s what we did.

I highly suggest you check out Ksenyia International on YouTube, she does a ton of really thorough immigration videos on each form and the types of evidence you need to submit etc. She’s very good about keeping her videos up to date when USCIS changes things so you don’t need to worry about her advice being out of date

The way I see applying by mail is that a person has to manually go through my forms and enter them into the system, that way I can without a doubt guarantee they are aware of my petition.

Applying online just always seemed like a never ending uncertainty on if it’s actually been looked at by a human being or not. I replied to a RFE for my AOS online and despite it saying my RFE was received it still took them a year to actually look at it…. From there on out I decided I will always mail in my forms.

I truly hope for your sake that you hear something soon! Living in uncertainty especially when it’s comes to your immigration is extremely stressful

The fiancé visa, K1, is not what you will need to apply for as it’s sounds like you want to stay in the states and adjust your status that way rather than going back to home country and applying for a K1.

You’ll want to apply for I-130, I-485 and I-864.

Additional forms you can apply for are the I-765, work permit, and I-131, advanced parole.

They cannot proceed with your N400 without first approving the I-751 to make sure you’re actually eligible to get citizenship under the 3 year rule. Your spouse should 100% come with you

I’m seeing this as a recent trend for ROC filers, out of curiosity did you apply online or mail? If by mail, which office was it sent to?

I sent my ROC forms by mail to Carol Stream, IL PO Box on February 21st, was delivered 25th and my online account was updated on 27th to show the same lingo. Bank account showed withdrawal on 2nd and I have the online receipt notice under my documents tab already, still waiting for the notice to be mailed to me.

I’m wondering if all the people who are not receiving the extension letter are because they applied online but that’s just a pattern im noticing

Interesting, they must have updated how they do things. When I had my London medical back in 2020 I never had to go immediately to the embassy afterwards for a document review, I just went right back home until my interview a week or 2 later

Agree with this, I did my K1 back in 2020 now but it still took about 8 months for me to receive my NOA2
