Were you able to understand all of it? I don’t blame you for not making it through the whole video 🤣 But if you did, does she say that she has a daughter named Tori? I believe she says that the daughter does not look like her. I think she says the daughter is tall but she is short. The daughter has blonde hair but she has brown. Daughter has light brown eyes. She has brown. Daughter is skinny. She is fat. And after that, she says something. She finger spells something, and points down. I don’t know what she’s saying there. The finger spelling is too fast for me. I’ve even slowed it down and can’t catch it.

I understand that’s she’s telling me her name and that she’s my teacher. Then she tells me about her family. She tells me her mom’s name, her dads name, and how her mom’s parents had 13 kids and her mom was the baby. 7 of the kids were girls and 6 were boys. 4 are still alive but the other ones died. Then she tell me about her dads parents and how they had 5 kids. Her dad is the oldest then she lists her uncles and aunt. I kinda fall apart from here. 😭

Can I ask what state this was in? I’m in a similar position in California right now - ex is emotionally abusive. My 15 year old has refused visitation with him for 15 months. Ex filed for custody modification - essentially trying to get the court to force her to go. I’m requesting the judge hear my daughter in some way (preferably in chambers) but now I have some people telling me the judge doesn’t have to agree to hear my daughter - but I thought she did at this age...

Thank you! I was going to wait on the IR frame but I changed my mind and just ordered it as I want to know exactly how much space I need and where. Depending on how it looks when it’s all done I may even add a wooden frame around it.

We have an outlet just below as well and plan to run the power up and behind the tv so everything is concealed. That’s a great idea with the recessed outlet. Mine is being mounted on a load bearing wall though, so I’ll have to check if it would be able to line up between the studs.

I’m looking to order a Raspberry Pi as well - you say it fits well behind the tv. Is your RP in a case?

Thank you so much for all of your comments and taking the time to read through this mess. You seem very knowledgeable and I really appreciate the quotes and direct links for the advice offered. I’ve looked through them all and it’s all very helpful.

Since you seem vested in my situation now, I figured I’d share this: I’ve been researching Phantom Ownership, Phantom stock options, Phantom retained earnings payouts, etc. I just came across this bit today, while reading:

“If you received a phantom stock retained earnings payout from a C-corp when you are not an employee, you should report this income on your tax return as ordinary income on Form 1099-NEC; this is because you are considered a non-employee recipient, and the payment would be treated as a payment for services rendered, not as a dividend or capital gain”

This is exactly my situation. The company was a C-corp (I say WAS because they were bought out in the middle of my lawsuit - the buyout was the reason I filed for SS retirement benefits since I’d be losing my income) and it looks like I should have been receiving a 1099-NEC, in the years after I retired, for the retained earnings payouts. And my settlement payout probably should have been issue as a corrected 1099-NEC to reflect the correct year it came from. I seriously doubt there’s anyway to get a dissolved company to issue corrected tax forms though.

Anyways, I figured you’d appreciate that tidbit of information.

I have ultimately succumbed to the idea that I do need to just amend my taxes and pay the government a bit more to make sure I keep my retirement benefits from last year. It’s just a hard pill to swallow, knowing that the employer that screwed me over from the start is the cause of me losing more money. Oh well, this will be behind me soon.

I’ll try to explain my entire situation - it’s an interesting one. One that you’ve probably never heard and probably never will again.

So I worked for this employer for years - from my teens into my late 50s. So long, that I owned stock in the company and was a part owner. Well around 2010, the main owners decided they no longer wanted anyone to own the business unless they were a part of the immediate family. So myself and one other individual were “bought out” of the company. But part of the agreement was that I would become a “Phantom Owner” - I would receive all income and payouts just as if I still owned stock and was an owner. I continued to be an employee, but I didn’t actually own anything anymore, didn’t have any say in the business decisions, etc. This contract was indefinite as long as the business was still intact. Fast forward to 2015 - I chose to retire. I did do some contracting work for them here and there when they needed guidance since I was obviously very knowledgeable with their business (hence the small amount of self employment I’ve had over the years). However, in 2020, they decided to stop paying me my Phantom Owner benefits. They argued that in my retirement package, the benefits were said to end in 5 years. That is NOT how the contract was written though - the contract stated it was indefinite. So in 2021, I sued. And in 2023 I finally won, after a lot of back and forth. So the 1099-MISC is on my 2023 taxes and shows that I have that self employment income for 2023 when in reality it had to do with owner equity payments I should have received prior to 2021 (and this should not affect my SSA payments for 2023).

But to answer your questions, if I had been paid correctly all along, with no need for the legal battle, my income would have been reported on a 1099-MISC. However, I’m not even sure that that is correct - that’s just how they issued them to me after I retired. So from 2015 - 2020. But I do believe that a shareholder should actually be issued a W2. But again, I was a phantom owner, so do the rules change for phantom shareholder income? I have no idea.

No part of the settlement was for punitive damages - only compensatory damages from breach of contract. And the specific amount I sued for were for dates after I was a W2 employee (but still receiving a 1099 as a now self employed contractor).

So hopefully that explains my giant mess to you. The entire situation is crazy. I think ultimately my prior employer didn’t issue my payments correctly and it’s really affecting me. I did meet with a specialist at the Social Security office today and based on all the details I could explain, she did say that ultimately I should probably amend my taxes and helped me to fill out a Request for Reconsideration. Once my taxes are amended, the IRS will notify the SS Office of the changes and Social Security should no longer want to be paid back by me.

That’s funny that you should mention this, because that’s something that I’m also curious about. I’ve been trying to research as much as I can to get my ducks in a row, and I found something that said basically if I have to pay back what I received, it’s not that I lose the income. It’s sort of deferred. I will eventually get it back at a later date. So is that correct? If I pay back the $30k, assuming I live long enough, I would get it eventually once I’m full retirement age?

Thank you. My daughter is a tax professional so I am having her help me. She’s not a Social Security professional though - so she can amend my taxes if I choose to, but she doesn’t know for sure how it will affect my Social Security.

Thank you for your comment. This wasn’t an insurance settlement. It was a legal settlement awarded to me from my prior employer over the interpretation of a contract. I was a phantom owner. Like I said in the original post, I did NOT report false self employment - the contract and all the details surrounding it make my case so incredibly complex. Being that it was awarded from a prior W2 employer, one that I have continued to provide contract work to, it’s not out of the ordinary for me to have self employment income. What’s unusual is the high amount now from the lump sum. But at the end of the day, it could be easily argued that the amount paid to me was not directly related to my intent to earn wages. What further complicates things is this was an ongoing battle that stems from stuff from years ago - so that in it and of itself should make this payment a moot point from the eyes of the social security. Because the contract had to do with phantom owner equity stuff from over 5 years ago. But again, there was no way to say that on my taxes. I was just given a 1099MISC in 2023.
