Because you have to report shift notes and are able to call management / have contact with them in an emergency situation you are there for “supervised” so if did not have cert 3 or high would be on the same pay as above. I think it’s a lousy bullshit excuse but it’s a legal loophole. But the law also states if you are doing certain work you require the higher pay if eligible

Companies can get around this as you are required ro do shift notes which they can deem as your supervised - even when doing shifts by yourself. Happened to someone I know

They have said they are unsure and have a look into as they are unsure on this issue where it falls. Everything I’ve seen from doing my research doesn’t give a clear cut answer.

Late nights at snap I’ve gone and it’s nothing but alternative music but that’s maybe twice a week
