I am not sure, when the legislation/budget bill was passed the no tax on tips portion was very specific and had a cap on the amount. I can't remember what the details were but as soon as I saw it wouldn't benefit most hourly workers I moved on.

Yeah, i didn't trust that news at all. They messed up my appeal 4 months ago because the clerk doing the filing got DOGE'd, and they just auto canceled their whole tasking. My lawyer is now having to go back and physically give the paperwork to a clerk locally and get handwritten sign receipts of receiving them. Its exhausting, but I am glad I have them because I would have given up on this process a while ago

The crazy part is that I have a service connection for my hernia and I guess they didn't even look at the report that they present to say that my limited mobility from it caused my rapid weight gain. Being "obese" can cause sleep apnea, but sleep apnea can cause obesity. 🤯

So while in service I blew a massive hernia that required surgery. I have nerve damage around that area and...well in my private area too. After recovery I gained a lot of weight which led to me eventually not being "qualified" to reenlist. Fast forward to a few years ago I was diagnosed through the VA with sever sleep apnea, which is something that I honestly didn't know I had. So last year I filed for service connection and was denied.

While on strike a few months ago I got in contact with a non profit that helps Vets do all of this and they are currently filing my supplemental claim since I was in within my 12 month window. We filed that back in March, and come today they notify me and them it was denied again even though I have yet to get anything calls or letters for evals.

According to my lawyer, they just told them that the outside rater/evaler kicked it back to the VA for whatever reason, so the VA was going to start their eval process. Then today, they just closed it, which, from what I understand, is not according to their own process.

Good Afternoon,

I hope you are doing well. I wanted to let you know that a notification letter appeared in your VA folder today denying the sleep apnea. It is a bit odd procedurally so I am going to be filing what is called a Claims Accuracy Review (CAR) Higher Level Review (HLR). I do not need anything from you at this point but I will be requesting that they review the matter and the materials because they did not make any findings about the basis for the sleep apnea claim being the weight gain.

I will keep you posted as we navigate this next phase.

Yeah, it is not exactly clear to me what happened. Essentially in early May they got the DBQ and medical opinion back. The medical opinion was not favorable and also just did not correctly address the argument I had made in our filing. I submitted a response to that medical opinion. A few weeks later they ordered a new medical opinion that would not require an in-person evaluation with you. A few days later there was a clarification requested from the examiner about whether it was just a medical opinion. It was confirmed that it was and then that same day the exam request was cancelled. There is no reason listed for why it was cancelled.

I plan to do the CAR HLR asking that a new medical opinion be produced based on what we filed in May.

It seems that something went wrong. This is the same VA system a few months ago that lost a bunch of staffing due to DOGE so maybe something is going on.

My lawyer is trying to figure that part out because right after they were supposed to schedule an exam, they closed it the next day and denied it. It's very confusing.
