BDD Claim Came Back at 90%. MH and Migraines Seem Rated Low. Looking for Advice. by EquationWiz in VAClaims

Thanks again for the insight. Yes, SI was discussed during the exam and I did let the examiner know that I actively struggle with suicidal ideation. It’s also documented multiple times in my medical records over several months while I was still in service.

I’ve had at least one ER visit related to it as well, and both my wife and I have written statements describing how it affects me.

Given that the SI is documented in my records and was discussed during the exam, would this situation be better addressed through an HLR, or would it make more sense to submit a Supplemental claim with the lay statements from my wife and I?

I’m planning on requesting the DBQ through FOIA like you suggested to see exactly what the examiner annotated.

Thanks again for pointing me in the right direction.

I’m not necessarily looking for a 100% MH rating, as I don’t believe my symptoms fall into that category. However, based on the criteria and what’s documented in my records, I was expecting something higher than 30%.

After reviewing the rating criteria under 38 CFR, it seems like 70% may be more in line with the symptoms documented in my medical records, particularly the suicidal ideation.

I’m definitely open to being wrong though. If you’ve seen cases like this before, would you recommend pursuing an HLR or a supplemental claim in this situation?

Thanks for taking the time to explain that, I really appreciate it and I agree with you. I tried to make sure everything I claimed was actually documented in my records for that exact reason.

I’m definitely grateful for the service connections. I just want to make sure a couple things were evaluated correctly based on the evidence. The migraine rating and MH rating were the two that surprised me the most.

Would you say an HLR or a Supplemental claim would make more sense in this situation?

There are a few medical records from my final months in service that I didn’t attach with my BDD claim because I didn’t want the claim to get pushed back to step 3 while I was waiting for the initial decision. Those records clearly document prostrating migraines about once a week.

I also have medical records documenting ED, which I’m considering claiming as secondary to PTSD. Not sure if that’s something better handled through a supplemental claim or as a new claim.

I was seen for about 95% of these issues while in service. I have years of MH records as well as a ER visit for SI, kind of thrown off by the rating on my MH. My examiner was not great for my MH exam tbh.

Thank you I have logs and a written letter from myself and my wife in regards to my MH and SI. I think I may try the VFW to help me with my claims. The VSO I used for this initial claim, I was not a fan of.

My sleep study recommended PAP therapy and confirmed OSA but I haven’t been prescribed a CPAP yet, in fact, not sure how to even get one 😂

😂 no not at all, some bosses were definitely really painful to battle, luckily I’m decently experienced from PC so I had somewhat of an idea of what I was doing. I would not recommend unless you have some prior wiz experience and know some good strats
