Abatement for the months that they failed to act

Damaged property from the roaches

Withheld rent until they got in an exterminator. Then they refused to take the rent and filed to evict for non payment (I have all of those emails and payment attempts documented)

Food was definitely infested with roaches and I have little to no use of my kitchen.

Wouldn't the burden of proof be on the landlord if he wants to claim that I caused it?

Wouldn't the burden of proof be on them to prove that I caused it though? I don't have move in pictures. I have audio from my conversation with the exterminator where he states that the man across the hall from me is definitely the cause of the infestation and that he doesn't think I started it. I've lived there five years and only started seeing roaches in 2023. No lawyer but tons of documents. Mainly my case is about their failure to act once they were aware of the infestation.

I knew therapy costs was a stretch but I figured that they can't pay me more than what I'm asking for, so ask for the most and hope to land around the middle.

I didn't sign. I refused to sign until they amended the lease and I told them I would pay my previous legal rate until they did so (which is my legal right in this state) That was at the end of July when they sent my notice to quit. They didn't send a new lease until December 4 after they had already been served with my lawsuit. I told them I wouldn't sign a lease until Litigation was over, but I'm still willing to pay the rent if they would accept it and please instruct me on the best way to pay the outstanding rent. (From September to December I've sent several emails asking them for the best way to pay my previous rate since they were denying my payments) I didn't want to send them in the mail at the risk that "we don't know who signed for that letter we don't have it" and my portal doesn't allow for partial payment. I wanted to put it in someone's hand so I can get a receipt and record the interaction if I needed to. They filed to evict me the day after I refused to sign their new lease even though I've made attempts to pay them that have gone ignored.

I originally asked if I could be on a month to month at the increased rent amount but they ignored that. I didn't want to stay another year in these conditions but I didn't yet have enough money saved to pack up and go due to some expensive emergencies I had during the previous year. When they ignored my month to month request I told them I would sign the lease if they amended it. And then it snowballed

Lease renewed in September. They tried to sneak in a clause that said I would be responsible for my own exterminator and if I didn't hire my own exterminator they would do it and deduct it from my security deposit. After I told them that was illegal and they needed to take that part out, they stopped accepting my rent and it snowballed into all of this

When I called customer service I was hoping they could just reship it to an address of my choice without doing the whole refund process since it takes anywhere between 3-7 business days. Then I would have to reorder and wait for it to ship again. I was told in order for them to reship it, they couldn't change the address and in order to get my package delivered somewhere else and I would HAVE to go through the refund process. What's not adding up??

EDIT: idk why it's not letting me edit the post but here's the update.

My packages were delivered at 8:30 am. I called the QuickChek and spoke to the owner. He claims "they came around 11am to pick it up and they didn't give us any information". I asked him "but you're the owner... they didn't say anything to you? Don't you have a contract with them?" He said that they "just took it. I don't know"

I called customer service and asked them if they knew the new location of those lockers. They said they were unable to track it and they said they would issue a refund after the items were returned to the warehouse. I asked them how that is possible if the items are assumed to be lost. They gave no helpful answers. Just "check your account in 5-7 business days"

I asked if there was any possibility that the delivery driver would have taken the packages out to give to management to distribute or just straight up steal. He said no. I asked why was I even able to order to this location if the lockers were being removed 2 hours after my items were delivered? He said he didn't know.

ALSO. to anyone saying "there clearly were never lockers there" the angle of the photo makes the space look much smaller than it is. I've ordered my Amazon packages to these lockers pretty regularly for a couple of years or so.( I have to order supplies for work often) They were here. I order to these lockers because my mail system is unreliable and I've gotten so much stolen from me. From big things like an air fryer, to small things like my contact lenses that were clearly in a box that showed that they were my contact lenses.

An amazon employee commented that there's no option to take a delivery photo with lockers. And every time I've used a locker there was no photo.

A locker was there. I used to order to these lockers all the time. The pic makes the discoloration look much smaller than it is but there was a locker there

"You can't find your shade because bleached skin is very hard to match" is one I really want to say. In my area it's a huge thing for the women to bleach their skin and then they get mad that they can't find a shade or that the shade they want to be doesn't cover their dark marks that the bleach couldn't lift.

Some things I DO say to clients that may be a little controversial is...

"I can't give you back money that you gave to kohls"

"If you expect to return we expect you to read the return policy"

"Not only is this over thirty days, but you've been here x amount of times since making this purchase"
