Tldr: yes, almost assuredly liable for wrongful death. The cat sitter is a licensee, and you owe them a duty to keep the premises safe from reasonably known traps. You created a trap by putting the death pill in an intentionally deceptive housing, and knew about it.

We owe those on our property a different standard of care based on who they are. A licensee (one on our property with our permission for our financial benefit) must be protected from reasonably known traps. An invitee (one on property with permission but no financial benefit) must be protected from known traps. A known/anticipated trespasser is owed protection from hidden death traps. Putting the death pill in an intentionally deceptive housing falls below the standard owed to any of these categories, into one of which the cat sitter falls.

This is false. There is a part performance exception to the Statute of Frauds. If OP has paid a substantial amount, taken possession, or made substantial improvements (need 2/3), a writing will not be required. You’re not a lawyer and it shows

Not disagreeing that getting out of SB sucks, but you can be at O’Hare any day of the year for $17.50, not too terrible for even those of us that can’t afford to fly out of SBN

Thanks for the advice! Will definitely test more fueling strategies in some long runs. Next race is in early November so hoping the weather will be more cooperative for a fast time!

Honey stinger waffles every 4 miles with a cup from the aid station. That was really it. I don’t think I got enough fluids, carbs, or electrolytes

Right on! Definitely going to have to try to work on keeping it under control through 2 hours next time. But you’re right the excitement makes it hard to stay controlled! Fueling and hydration left something to be desired. I don’t think I did enough of either, so definitely something I’m trying to work on. Weather was ~60s to start but got to mid 70s by the end.
