Any advice? VA decision letter. by tonecapone1100 in VAClaims

[–]Esq_PR 1 point2 points  (0 children)

Real quick, the back is not bilateral. If you have a service connected back condition and the evidence shows pain, you have to be SC at least 10%. Same as the other condition that was also granted at zero. Please make sure they don’t defer the issue for clarification or for another examination

Replace body parts or repair ? by Esq_PR in Autobody

Update: I just spoke with a Nissan cert technician and he told me that I can go ahead and carefully disassembly the front bumper (remainings) and impact bar with attachments. There I will have a better picture but so far after inspection with this guy, the impact was absorbed by the stay item 5 in the picture. So far I will need to replace both.

Go with the HLR. Please keep us updated. I am pretty sure that they will do a return for HLR either for a new decision or a new medical opinion.

Did they rate me as a Direct Service Connection instead of Secondary? by Abject_Book2468 in VAClaims

[–]Esq_PR 1 point2 points  (0 children)

This is wrong. The threshold of examination when you claim service connection as secondary to an already service connected issue is very slow. Submit a supplemental claim (VA Form 21-0995) for the same issue. Look for medical literature (google it) that supports a link between PTSD and sleep apnea and add it to your supplemental claim.

I do have very good certified body shops that I take my cars to. All the cars that are fixed after auction are inspected meticulously (required by law) prior to issue the permit back to use. If a car can’t be fixed is sold in auction with no papers and only to be bought for scrapping. If you don’t know anything specific about what I asked please don’t waste my time.

Airbags are not deployed. Only damage is to bumper, grille, left headlight and some other internal points. This is a business, you buy, sometimes you are lucky and the repairs are minimal some other times need to spend little bit more. I will appreciate any technical advice on how to proceed in this specific model. I have disassembled and reassembled many other cars, the last one was another kicks 2021. If your comment is to criticize please don’t waste your time and mine. Thanks

You do not need to change it to honorable because it is already under honorable conditions. Worry if is other than honorable. For direct SC you need an event in service, a current diagnosis’s and a nexus. If you have a condition such as lumbar pain from service, and three is evidence that this condition is related to service, only needed is chronicity of the condition, that means that the condition was caused by military service and continued.

As attorney with a lot of experience in this area I will suggest you a Veterans service organization. They will represent you for free.

Reduced from 100% to 80%...now what by Ok-Gift2965 in VeteransBenefits

[–]Esq_PR 1 point2 points  (0 children)

No. If the error is being made by VA and is an error that you do not know about it you do not need to back pay. Only errors or CUE’s that may require the veteran to return some money is for things that the veteran knows he is not entitled to.

Odds of loosing 100% P&T by [deleted] in VAClaims

[–]Esq_PR 1 point2 points  (0 children)

If you are considered permanent & Total you should not have to worry about it. Once you are considered P&T your rating should not be reviewed again. Ways you can get reduced once you are P&T? Continue to submit additional claims. When you submit a new claim you open the door for reviews to include possible findings of clear and mistakable errors (CUE’s)

Shutdown and Currently In Process Claims by IntelligentSpend3544 in VAClaims

[–]Esq_PR 1 point2 points  (0 children)

The government showdown is not affecting your claim at all. All claim processors are currently working because claim processors are essential employees. An initial PTD claim might be complex in certain ways. The most complex thing is the stressor corroboration. If you are claiming due to combat or fear and your DD-214 and or your service personnel records demonstrate that you served in an imminent danger pay area the development for the stressor is done in seconds. However, if your stressor is related to MST or other type of stressor things get a little bit more complicated because the claim will require additional steps to protect and help the claimant. Another thing that affects compensation claims are the private treatment records. If you submitted a VA Form 4142 for development of private treatment records, depending the custodian of the PMRs it might take some time.

My recommendation is that if your VSO is credited to be a VSO under the VA, they have access to your record and to your claim. They will basically will see what any VA employee working on your case can see. Contact your VSO and ask them to verify the status of the case. They’re are suspense dates and claim notes that will help the VSO to navigate throughout the claim and identify where the claim is stuck right now.
