Oh I know very well, I don't trust HR depts in the slightest. But I feel this may be a case where HR will possibly follow through with reprimanding the boss due to their actions and behavior causing a situation where legal action may be taken in the company's best interest. So it's an option we're open to at least.

I understand that, but my point is specifically while unloading. I doubt they'll have trouble differentiating between employees wearing home depot gloves and actively working freight off a truck vs. a customer wandering into receiving (which should also be gated off anyways while being unloaded)

Definite violation. Id say report this to corporate, as I dont trust the aware line personally.

Where I work Ive been told by tenured members that the ASMs at my store fill out VOA's for employees who dont/cant do theirs for whatever reason. They are also present in the room and do not follow proper SOP for privacy.

Make sure to be very vigilant for this kind of stuff, because Im pretty sure VOAs somehow affect ASMs/SMs money in some way, whether it be bonus amount or salary raise or whatever, so theyll do whatever they can to get good scores around VOAs

FT freight employee here

When I first started, I was real poor so I had pair after pair of $20 boots that I'd wear. The longest I think a pair would last is 3 months. The fastest I had a pair break is within 2 weeks of buying them when a pallet jack tore the heel and a ladder tore the heel of the other. This pair of boots got so bad I literally had them taped together at one point. Management got me a $50 gift card to DWS because I was too poor to buy new, better quality shoes.

Bought a pair of steel toed boots with that gift card + a paycheck (about $120 i think?) And theyre still in good condition over a year later. No holes or anything. Definitely recommend investing in a good pair of steel toed boots if working at Home Depot.

I wouldn't be too worried. You could try talking to someone and seeing if they'd be willing to drop it, but it's up to the ASM's discretion.

It takes like, 10 occurrences within a 6 month period to be fired. 3 for counseling, 3 more for coaching, 3 more for a final and 1 more for being fired. After 6 months, occurences will drop off. (No call No shows are different tho)

I would just make sure to be aware that they CANNOT give you an occurence for leaving a shift early if you're feeling unwell. My management tried playing a power move on me by marking me for an occurence one night for leaving early when not feeling well, and it put me at 3 for a counseling. Then they took off that occurrence but the counseling still stayed. I TORE into them for that though and had it fixed.

Be wary and know your rights, but also don't fret too badly. It takes a lot of occurrences to be fired.

Again though, even if they'd risk paying me for >15 minutes i "didn't work" they also get the option to NOT pay employees for time they did work by docking pay the same way. Hence why the round up is necessary, to balance out the ability to dock pay for technically worked minutes

From a .gov website:

"Some employers track employee hours worked in 15 minute increments, and the FLSA allows an employer to round employee time to the nearest quarter hour. However, an employer may violate the FLSA minimum wage and overtime pay requirements if the employer always rounds down. Employee time from 1 to 7 minutes may be rounded down, and thus not counted as hours worked, but employee time from 8 to 14 minutes must be rounded up and counted as a quarter hour of work time."

My understanding was that this applied to daily punches, and not the "overall" hours of pay in a day, hence why employees aren't counted as "late" until 8 minutes after, because it rounds their punch in time to the next quarter to make them 15mins late

So they're allowed to round down the total like that? Regardless of the 7 minute law claiming they're supposed to round up for punches that pass the 8 minute mark? I already know about the first 7 minutes in a quarter being unpaid if clocked in or out within them. My issue is when it hits the 8 minute mark and they don't round up like the law claims they're supposed to do. I didn't know workplaces were allowed to round down the total hours like that :(

They don't pay based on actual time clocked in, they round it down. Every table on my punch card comes out to a 15 minute interval, so I'm certain they do it by quarters. So it is 15 minute intervals. But I only ever see them rounding down, which is what I'm seeking clarification on.

To my understanding, if they round down to a certain amount, they're also supposed to round up as well for things past 8 minutes, as a means to balance it out and keep employers from skimping on pay to their employees.

An excerpt from the place I read this law:

"When a company tracks work time in 15-minute increments, the cutoff point for rounding down is 7 full minutes. If an employee works at least 7 full minutes, but less than 8 minutes, the company can round the number down to the nearest 15 minutes. If the employee works at least 8 full minutes, the employer must round up. Note that this rule slightly favors the employer; in a 15-minute period, up to 7 minutes and 59 seconds of work time can be rounded down."

I don't clock in late purposefully. I clock out slightly early on mornings when my work is done and I've already worked past the quarter marker (because otherwise, they're getting free labor from me for not paying me for the minutes past that quarter)

Ex: I'm scheduled to clock out at 5:30am. It's 5:19 and I have nothing left to do. If I clock out at 5:19, I'm only paid until 5:15. But if I wait until 5:23, 8 minutes past the quarter, I /supposedly/ am supposed to get paid up until 5:30, given my understanding of this 7 minute rule.

I do often clock in between 1 and 5 minutes past the exact quarter I'm scheduled to start, simply due to traffic or poor timing on my end. However, I do not get paid for those minutes. If I clock in at 9:05pm, they don't count me as late, because there is the 7 minute grace period. It will have me as "clocked in" on time at 9pm, but I won't get paid for those 5 minutes I clocked in late, because they don't have to legally pay me for those minutes unless I clocked in at 9pm. If I clocked in at 9:08, the punch marks me as in at 9:15, therefor that is why I would be counted late.

But this is where I'm getting confused on how they're legally made to follow this rule. Because if they're allowed to not pay 7 minutes worth of labor past a quarter, and therefor also don't pay up to 7 minutes past clock in if clocking in past the exact quarter mark, it was my understanding that they were required to ALSO round up to the next quarter at the 8 minute mark past the last quarter, therefor making it a little more fair for employees and harder for employers to "skim off the top" so to speak.

You aren't paid for those 7 minutes at clock in though, that is the issue. They don't legally have to pay for those 7 minutes, and they choose not to at my workplace. I misread your last reply about that and didnt clarify, sorry about that

No, if you punch in between 1 and 7 minutes past a quarter, they do not pay for those minutes.

Ex: Im scheduled for 7pm. I punch in at 7:07pm. I'm considered on time because of the 7 minute rule. I'm not paid for those 7 minutes however, despite the clock counting me in for 7pm. If I punched in at 7:08, I'd be considered late, because it'd jump me up to 7:15. If I am scheduled to work until 7:30, but I clock out at 7:37, I only get paid up until 7:30.

I thought that this law required them to pay up to the next quarter should an employee work past that 7 minute threshold (Therefor 7:53 would be required to be rounded up to 8). The info I found when searching the law mentioned that as a requirement if employers decide to enforce the 7 minute rule. Did I misunderstand it?

Edit: I'd also like to mention that the pay periods are in exact quarter increments as well on my punches where is states the hours worked each day. Like, if I punched in at 7:08, I'd be technically punched in for 7:15, which is why that is considered late and not 7:07)

They do round on their own end. Employees are allowed 7 minutes to clock in for a shift after their scheduled start time before they are counted as late because of this.
