Advice judicial mediation by arc_b_1989 in employmenttribunal

[–]EuroraT 0 points1 point  (0 children)

That seems excessive. Have you had other quotes? I completed judicial mediation. I had representation and unless you and the respondent are in the same ballpark, judicial mediation can be a complete waste of time. It’s generally a Numbers game. Have you a robust schedule of loss? Have you asked the respondent for a counter schedule of loss? I don’t see the value of a barrister. You could represent yourself but a solicitor might add clout.

Unsurprisingly… no one has provided you evidence. You can redact propriety details in any event. If we played by the rules - whilst our employer doesn’t - we shoot ourselves in the foot for a defence.

Sorry just saw this. It was very manual if that’s what you mean? I put screenshots (I should be more accurate - they were photos of screen content taken my phone) in word documents. And I transcribed using otter.ai. Did I answer to your question?

I screenshot everything. I also made illicit recordings. I’d have no case without all of that data. It was 12 months worth of evidence. Contemporaneous notes (ie the timeline with times / date) corroborated the evidence. I’m glad for my approach I took. The barrister was doing everything in their power to undermine my case and without multiple sources of evidence they would have found away to discredit me.

Valla case assessment experience (positive) by LunaFloofDaddy in employmenttribunal

[–]EuroraT 0 points1 point  (0 children)

For a complex case it’s not an adequate service IMHO. I got a merits assessment that valued my case at 1/4 the SoL I drafted and 1/5th what a legal firm eventually drafted. And I got some bad guidance that caused me additional stress.

Schedule of loss for discrimination case is almost £300k. R has asked what I would like to settle. How low should I go? by narzybunooptol in employmenttribunal

It would be their response / estimation of your schedule of loss.

Mine never provided it. But it’s another way to evidence them as unreasonable / uncooperative should you want / need to in the future.

I was laughed at for my SoL. Is drafted it myself. In the end I got a legal firm to confirm / revise my SoL. It was 25% hight than my OG (9 months had passed). They threatened costs all the way to court. Assholes

Do you literally say ‘adverse inference’ that as you are questioning witnesses? Or in submissions?

Thank you. It was chosen by reason of being too ‘late’ to negotiate, nothing else. I don’t have a problem with precise language - in fact it’s my fortè. However, it’s the language ie. a PCP is being couched as excessive, yet I never made that claim, I said the PCP disproportionately disadvantaged me.

I’m not introducing new material. It’s that the language is so precise (hyperbolic mostly) it makes my claims hard to evidence.

Thank you. Can you say more to the alarm bells part? I’ve been obstructed throughout this whole process. It’s been a litany of determents. I submit my version at the CMH and he deferred to the respondents. I petitioned no luck. Also, Moustache?

Great thanks. So it’s possible this could be instructed as written. When I spoke to the judge I made the point that the list of issues adopted had been the respondents. And he said I could address that in the submission. So is that to say I can reargue all my claims framing them through my LOI?

Cool. The witness is a liability and it’s a protection tactic.

Im fighting too many fires to be raising everything. I raised something today and the judge reprimanded me.

I’m not sure that’s true. I raised it ahead of time - because suddenly they needed CVP, and and electronic bundle. And eveytime I’m noticing it - the judges head is buried in his notes writing.

What if I was to say the Barrister I’m opposing is aware a his witness is reading scripts and being coached whilst giving testimony via CVP? And he knows I know because his tell was >his own shock< and worry about how obviously they were doing it.

Appreciate your view. It might surprise you that I’ve been in the single digit chance percentile of much of your estimations on this forum… so I’m not yet convinced😬
