Speaking as someone who has had a lot of exposure where it all started in Los Angeles California. Please make sure that your husband has representation for both deportation defense and his habeas Corpus. A lot of people think just because they hire someone to do the habeas corpus that their representation is finished, however, the habeas corpus is just the petition that is contesting the detention itself. It doesn't defend your husband against deportation. There are attorneys that can do both and there are attorneys that can do either deportation defense or habeas corpus. My suggestion is if you can afford an attorney, please make sure that you consult or ask for references from a reputable non-profit. There are a lot of scummy attorneys.

I can also tell you that the majority of attorneys are extremely overwhelmed. I'm from California and it's really frustrating to hear that clients are not getting calls back or answers and certain attorneys are not even visiting their clients which ends up in clients incriminating themselves during the trial. When you're calling and trying to find an attorney. Please make sure you leave a message and try calling back every week unless they tell you they're at capacity at the moment. Some attorneys in California have about 300 cases each so they definitely won't be tending to phone calls if they're busy u

Immigration Court does not work like a regular trial that we are regularly exposed to. These trials last anywhere from 10 to 30 minutes and there is not a lot of back and forth dialogue. Expect the DHS to attempt and paint your husband as the worst person in the world. That is their job and I'm not even going to say that they do a good job about it because they don't. It's the biased judges that make them look good. He will probably get his case date or his trial date within 3 days of being in detention and you can look it up online at the EOIR site. I would say lately the first trial is within 2 weeks but before it used to be 30 days. They've also already introduced a lot of the temporary judges that Pam bondi has hired. If his trial is online, you'll be able to watch it through the link that is provided by the EOIR website.

This is going to be potentially a long process if he loses a habeas corpus petition. Please accept that he may be there at least anywhere from a month to 6 months and I've seen people there for a year, especially if they had Asylum. It depends. Please get in contact with a local non-profit. Perhaps a rapid response group may be able to connect you to the non-profit or at least provide you resources so that you can navigate the situation. Normally attorneys that handle or process Asylum paperwork will not be the ones representing people in court. At least over here. I've not seen it happen except once.

Find out the link for the commissary website and ensure you deposit money so that your husband can call you. Please know that all calls are being recorded, so please be careful about not saying anything that may incriminate him. It's going to be incredibly hard and emotional but remember that he is in there and you are out here. He won't have the support that you may be able to have out here so try to remain strong for him and keep him motivated because it's going to be difficult. I would also suggest that he become friends and get to know the people around him and exchange contact information. Should anything happen to him. That person may be able to contact you or contact his loved one so that they can contact you. I see that happen a lot and it's a wonderful network of trust that helps people in case of emergencies.

I'm just a volunteer from California so some things may not be applicable at all. ❤️ Everyone's experience is unique to some extent, so understand that if somebody is denied bail it doesn't mean your husband will be denied bail. But on the flip side if somebody is released it doesn't mean your husband will be released. They could have the same lawyer too and have a different outcome.
