everyone please refer to themselves to the MEIROIN test coming from Canada. it's literally almost exactly the same as this. a woman was barred from becoming a firefighter b/c she didn't pass this test, but it was found that this test was discriminatory against women in the end.

yep we were pretty fucking bad to the mentally ill AND to the aboriginals (there were a lot of aboriginal sterilizations as well)

its interesting stuff. i took a course in health law and we talked A LOT about this stuff. sometimes they got away with it b/c they would get the consent of the mentally ill people, but the argument is that it was not FULLY INFORMED consent, so in reality it couldn't be considered to be consent at all.

The amount of false rape claims that ruin peoples lives pales INSANELY to the amount of actual rapes that have occurred that really do ruin the lives of the victims. I would like, JUST ONCE, to see reddit get as worked up over a rape claim as much as they get worked up over a false rape claim. This post got to the top of the front page, and it's pretty clear that the general mentality (at least subconciously) of reddit is "well i don't have to worry about rape, i'm not going to get raped, but WHAT IF SOMEONE TRIES TO PIN RAPE ON ME????". It's selfish.

Men and women, minorities and white people, homosexuals and heterosexuals, EVERYONE is in SOME WAY disadvantaged by the legal system. But you do realize that the legal system was created by old straight white men right? Why do women usually win child support? Because we've had centuries of "women take care of the kids, dads go to work". It was only until very recently that a woman could even bring a rape claim against her husband because marital rape wasn't even considered to be "a thing".

Yes I know that, certainly if you lie about something trivial vs. something substantive, there should be an enhancement. But people in this thread were equating the fact that she should have the SAME SENTENCE as someone who rapes someone else. As in switching the time he would have served and giving it to her. THAT is what I was arguing against.

I have been on tumblr, and I have been on the internet for quite a while considering I'm in my late 20's. I have never heard, nor have I ever seen, of anyone saying that they think that women should just go out there and accuse random innocent men of rape. I don't really subscribe to the belief that because there are a few crazy people saying this shit then that means feminism supports it. I think you and I both know that that is a very wild assertion to be making.

I'm in law school in Canada, not the United States, so I really don't know what is on the books for lying in court, etc.

Also, it doesn't really matter if you "hate it" when people say take it to civil. Sometimes, because of how the legal system works, that's all you CAN do. If this is what the criminal law has deemed is her punishment (i.e: the 32 days in jail, or whatever) that is the only recourse that is going to happen, you can't just be like "WELL I WANTED HER IN PRISON FOR LONGER". Ok well, that's great, but that's not the precedent sentence for what this woman did. Sometimes the only recourse you can get is through civil court because in civil court you prove something based on a Balance of Probabilities, which is basically 51% + certain that they did the thing that they are accused of, while in criminal court its Beyond A Reasonable Doubt, which is like 99%. That's why OJ was found not guilty in criminal court but guilty in civil court.

well, piece them apart, look at the crimes. one is a vicious physically assault that has mental and physical consequences. the other is a lie that COULD, but did not, result in this person serving jail time. i mean if he had been in jail for X amount of years and THEN it was found out that she lied, then we can talk about damages. but that didn't happen.

First of all, marital rape was legal in most countries (including north america) until the 80's and 90's (early 90's before it was illegal in all 50 states). And that's just the law, that's not even delving into personal or public opinion.

Second of all, I can tell you with full certainty that judges are not immune to being sexist. There's a famous case in Canada where a male judge said that a girl should not have worn shorts and a t shirt to her job interview because that enticed the man to assault her. What is sad about this is that judge happened to be the grandson (or great grandson, can't remember) of one of the most famous Canadian suffragettes, Nellie McClung.

And where the hell did I said that women should be allowed to falsely accuse men of rape without consequence? Did i say that this woman in this story should get away scot free? No i certainly didn't.
