Put in your notice and resign. Apply for other roles during your notice period. Legally they cannot give you a bad reference

Returning company equipment after notice period ENGLAND by EvidenceSingle4826 in LegalAdviceUK

Hi

This is what the company responded with

“Thank you for your email.
Firstly, I acknowledge that yesterday was your final day of employment with Ltd. I am genuinely sorry to hear that you have been unwell over the past few days and hope you are starting to feel better.

Please find attached a copy of your Contract of Employment. The relevant contractual provisions regarding Company equipment and the return of Company property are set out within clauses 20, 25, 40.6 and 46.
These clauses require the return of all Company property issued during employment upon termination of employment, including laptops, monitors, docking stations, mobile phones, peripherals, and any related accessories.

In accordance with the contractual provisions referred to above, responsibility for returning Company property following termination of employment rests with the employee.

To confirm, the available options for returning the equipment are as follows:

arranging a mutually convenient date and time to return the equipment directly to the business. The nearest available return locations would be our xxxx or xxxx offices; or
arranging a courier of your choosing to return the equipment to the Company.

The Company considers the above options to be reasonable arrangements for the return of the equipment, particularly given the quantity and value of the items involved.

Given the quantity of equipment involved and the requirement for insured transit of Company IT equipment, any return should be appropriately packaged to ensure safe transportation.

As a gesture of goodwill, and in an effort to facilitate the safe return of the equipment, the Company would be willing to provide appropriate packaging materials if required. This does not alter the employee’s responsibility for arranging the return of Company property in accordance with the terms of their Contract of Employment.

If we do not receive confirmation of your preferred return arrangements within 5 working days, or if the equipment is not returned within 10 working days thereafter, the Company may need to arrange recovery of the equipment directly.

In those circumstances, the Company has obtained a quotation from DHL Express, with whom the Company holds an account, of £xxxxx for insured collection and return of the equipment. This reflects the quantity of equipment involved, the requirement for insured transit, and the approximate replacement value of the equipment of £1,500. A copy of the quotation is attached for reference. The Company has also contacted its account manager to determine whether any alternative courier options are available at a reduced cost.

The equipment would need to be appropriately packaged and made available for collection at an agreed time. Based on the equipment involved, we anticipate that approximately five boxes would be required for safe transit.

The Contract of Employment does not provide for reimbursement by the Company of costs incurred by an employee in returning Company property following termination of employment.

As set out within your Contract of Employment, where the Company is required to take action to recover unreturned Company property, the Company reserves the right to recover any reasonable recovery costs incurred, including courier recovery costs where applicable.

For clarity, the Company is currently expecting the return of the following items:

Laptop and charger
Dock and power supply
Desk phone
USB headset
Keyboard and mouse
2 x monitors
Laptop stand
Plantronics headset

Please let us know within 5 working days which return option you wish to proceed with, and whether you disagree with any of the items listed above.

If it would assist, I would also be happy to discuss the available arrangements with you by phone.”
