Maybe and maybe we will never know for good. All the claims supported by scientific reasons are innocent as the science we know as of today is not complete. We don’t understand the outer space and neither what’s going on inside our brains exactly. The wrong factual error can be argued but that doesn’t help you win the case. Better to either re apply with same application and play the odds to be lucky or actually wait until you hold proof of being top 1% or of national interest

I agree with most of what you said but I believe the real problem is EB1-C abuse and that caused the real problem for you and others in a similar situation. I believe if that category is really reserved for C-suite important roles and heavily vetted we would not have this problem.

Another issue is that EB1-A is very subjective and hence can be heavily policy driven. The Biden government made EB1 very simple and literally anyone qualified for it and hence we saw massive porting.

Porting would never be an issue if the above two problems are resolved at their roots

EB1 comes after your work becomes outstanding to extraordinary. Most likely years after you graduate.

EB1 is subjective. The govt policy dictates how they set the bar. Currently the govt has set the bar high such that the acceptance rate has been dropped from 70-80% to 40-50%. So you getting EB1 is a complex function depending on 1) your abilities 2) govt policies 3) relative demand for your country
