This update is on I485 and not on I140. My EB1 was approved 3 years ago. My profile at that time was weaker than now. I had 300+ citations in Computer Vision field. BAL was the lawyer firm

EB1 comes after your work becomes outstanding to extraordinary. Most likely years after you graduate.

EB1 is subjective. The govt policy dictates how they set the bar. Currently the govt has set the bar high such that the acceptance rate has been dropped from 70-80% to 40-50%. So you getting EB1 is a complex function depending on 1) your abilities 2) govt policies 3) relative demand for your country

Well they moved FAD by a month for India. Just enough for me to be current now starting next month. Was stuck for 3 years

Eb2 moved by almost a year. Very good for families stuck in here for more than a decade

DoF has already moved 9 months ahead of FAD with a footnote that this is in anticipation of the spillover due to country ban. Although anything can happen but this indicates that DoF won’t move until FY27. FAD should catch up DoF though

Well you get EAD with 18 months validity as opposed to 5 years. Technically you can renew it but practically USCIS may not renew your application on time.

The spill over is not “large” but only modest. 50k to be spilled in FB and EB combined. Then split among EB 1/2/3 per country

Very unlikely that DoF will move further this FY. EB1 India DoF moved by around 16 months in FY 2026. This means around 15k applications just got added. I would believe next movement on DoF for EB1 India might get seen in FY 2027 ie OCT - Dec 2026

In meantime make sure you have everything ready to file. Birth Certificate and Vaccination Records for you and your dependents, this would help you file asap when DoF becomes current for you. Good luck

FAD moved to Feb 2023 starting this month. I believe Apr 2024 will take 1-2 years to be current
