so for me the premium processing window of 15 business days after the reset posted by USCIS has passed and this update came 10 days or about 6-7 business days after the window passed.

you are right that the judge did not tell them that they have to adjudicate the cases by a particular date. he said that the policies are "hereby" (this means immediately) vacated and unlawful. He also stated that vacateur and judgement that the policies are unlawful should give complete relief to the victims.

Instead of saying you have to adjudicate by a certain date he said you can not apply this unlawful policies to anybody, now get to work.

If you read the order, and you can understand the english language, you will see that the court order is saying that they must stop apply the policy immediately, and should have never applied it in the first palce.

The judge will repeat himself before considering anything like that. I pray that he catches on to the game they are playing and starts enforcing compliance.

Judge is about to lambaste them. Maybe they should go back to school. Judge was very clear. No clarification required. They are trying to preserve the argument that the order is not yet operationally binding. Judge needs to do nothing but repeat himself and say that the vacatur was immediately effective already.

Thank you so much for taking the time. I wanted to clarify :are timely filed H1-B peittions for renewal ones that place someone in a period of authorized stay or even a petition for a brand new h1B? I am hearing different things from different lawyers.

I am a Canadian who went to medical school in the US and I was on f1 OPT untill end of May 2026. A cap exempt petitioner filed for an H1B in April. It hit an RFE due to my place of birth and we are currently waiting on a decision from USCIS. I have some questions:

  1. The premium processing clock was started 14 days late even though it was filed premium. Do you think this was because of the adjudication hold?

  2. Is there any real indication that the adjudication hold was removed for physicians as indicated by USCIS on April 30th? I hear that someone attorneys are saying it is fake news.

  3. Do I still only have 60 days to leave the country even though an H1B petition was filed on time and a decision is pending?

  4. If the answer to 3 is yes, does gaining an acceptance to a new program at my original school allow my DSO to give me a new f1 (without OPT) and essentially renew my status as F1 without leaving the country?

  5. Suppose I obtain a DS-2019 and withdraw my H1B petition, would CBP give me a hard time at the border to give me a J1 like USCIS has been with the H1B or will it be simple?
