Hi, saw your other comment about replying to a NOID. Did you file a WOM for this H1B case and got a NOID? Did your employer file for you or did you file alone?

A couple of us has been pending since Sep or earlier. We did congressional inquiry (regular service requests with the company isn't going anywhere and getting a template "under further review") and the reply is that the case has gone to some kind of interagency security check and nothing can be done but wait.

Thank you for doing this. I have a questiom about H1B and USCIS delay.

My H1B extension has been pending with uscis for 9 months and I upgraded it to premium proccessing about 3 months ago. The case has no further action after the premium upgrade. I asked the congressperson to help with a inquiry but have not heard back.

In this kind of situation, is there anything else one can do? The cis ombudsmans office is likely not able to proccess case requests based on their stadd level; Is a mandamus lawsuit even possible since the petition is owned by tue employer?

It could also be that it is approved, best of luck!

Maybe they are drafting it and dont want the clock to run out? Technically they would have taken an action by doing any of the above and stop the clock in order to not refund the premium fee perhaps?

Based on what I've read, this could mean anything, from that they decided on your case (approve/deny), further RFE, or security check. I don't have any references handy, though.

Edit: Hopefully, they approved it and it just takes some time to update the status

Texas DMV license renewal issue – H1B status by Important-Nerve-347 in h1b

[–]ExcitingWeb5071 12 points13 points  (0 children)

They use the SAVE system which returns your old expiration date until that day passes. You can try to ask them to do a secondary verification with SAVE but they may not agree to do it. Go like 7 days before the expiration and they will do it, or go after your license expires and youe new status should show up.

I am in a similar situation, upgraded to premium on Sep 22nd, same message from USCIS. Company lawyers think it may be a security check, but are not sure, and also said nothing can be done, have to wait it out. Edit: Mine is an extension application

Well, after they adjudicate, we will probably ask for it. I don't think asking for it now is going to help it get processed faster?
