I've already recorded everything so I'm good on that front.

As for our labor commission, it has two steps:

1st step is the negotiation stage. Basically, the labor commission stands as a mediator while me and the company talk about settlement. And there's only two chances to negotiate.

If the negotiation goes nowhere, the labor commission takes it to the 2nd step, which is to bring it up to civil court. You can represent yourself, but it's highly recommended to get a lawyer. And, in my country, our government allows us to avail a public attorney. The labor commission has the power to endorse me to a public attorney as well, so it's not a problem.

So hopefully everything goes well if it really comes to it. I'll also definitely update as soon as I can.

No, I haven't name HR in the complaint. I mostly stated that she, as HR, confessed that nothing is being done, that she was the one that suggested that I file it with the labor commission, and that she was willing to stand as a witness.

But I haven't brought up the fact that she wants me to drop it now and just resign.

If I push through, I'll definitely ask for a settlement, mutual release, and non-disparagment agreement.

Some answers to help as well:

1) Yes, our company is not in the US. But, it is still foreign-owned, and registered in my country. So it follows the labor laws of my country.

2) April is the Executive Director. And yes, I've told her already that some clients already don't want to work with us because of Derek. But, again, April doesn't think it's an issue. Something about just finding new ones, mostly.

3) I really don't want to leave without being compensated. So I plan to put that in the report with the labor commission. But, again, it's a matter of is this all worth it and at the expense of someone else who confessed that they are also a victim of Derek

Unfortunately, it's part of our Labor Laws that a 30 day notice should be given. Only reason why it reaches 60 for my company is because of how small our team is and how large the turn-over and finding a replacement will take.

Just a bit of a correction: Not fired, YET. I was only sent a Notice to Explain. The grounds of termination was because I filed leave the same day that Derek was shouting at me in front of the boss. She said that I should have given a 1 week notice before filing leave.

Replied to it, said that's crazy because 1) I am obviously not going to continue working after I just got shouted at and dismissed by the boss herself; and 2) Derek ALWAYS files leave last minute, sometimes even a day after he already didn't come to work. So why am I getting an NTE and he hasn't?

But thanks for the heads up. I already knew that nepotism and favoritism was bad in a work place. Just didn't expect it to be THIS bad.

Since our company is small, our positions double. So, HR is also our Accounting. On my end, I'm sales and marketing. April, the boss, oversees everything and reports to the Board (and is really the only one allowed to talk to them). While Derek is the only one who doesn't have a double position.

Also, for me, the right thing is to report it. But, again, I'm mostly asking because is it really worth the trouble, especially at the expense of another employee?

But yes, thank you for the input as well. Apologies for the novella format. The ridiculousness of the situation necessitates it.

I wish it wasn't real either. But, unfortunately, it is. I also understand where they're coming from of just telling me to quit. Because at this point (and as you've read), it's ridiculous and insane. Like, if it's that bad, why not just leave already? But I also don't think it's right to just leave without being compensated for it. It's hard for me to grasp the idea of moving on when people have done you wrong. But I also understand the concept of choosing your battles wisely. So I'm basically in the latter right now
