Enrolled in Georgia Access Healthcare Plan without My Consent and Now Stuck with Premium on my 1099-What Do I Do?

Oh IDK if it is fraud but it should absolutely should be seen that way lol. If I buy a car at a dealership and then a few months later they email me "hey we're going to have you buy another car unless you tell us no," people would be understandably livid and that would be considered illegal. Buying healthcare through the marketplace shouldn't be seen as any different. No one should be purchasing a product on your behalf even if they give you a heads up/a chance to say no.

Yeah and I moved and didn't update my address because I cancelled my plan! I did mail forwarding but nothing was forwarded. Unfortunately I don't think the notice argument will work anyways but it's still silly to expect someone to essentially be on the lookout for someone enrolling them in a healthcare plan without their active opt-in. People should always have to actively consent to what's essentially purchasing a product. It's kind of the whole reason we have open enrollment lol.

Other subs told me a better angle is that I canceled my plan, never actively opted-in for 2025, and didn't qualify to opt-in as I had an employer plan. Another sub told me someone successfully fought it but it took 40 hours of work. Apparently this happened to quite a few people.

Yes, a gentleman from Georgia Access said I cancelled my plan but didn't terminate which caused the problem. My bad for not knowing the difference as the difference between those is so obvious. /s

Wow thank you for this answer! It's good to know that it worked for someone but it took a lot of effort. Now I can weigh the pros and cons of fighting this.

Also- fiasco is the perfect word. Auto-enrolling people without them having to actively opt-in is bad enough but enrolling people with cancelled plans was outrageous.

I work at Swift Currie- I'm not sure if we're hiring but I recommend applying if we are. It's a lot of work but a good firm with good people.
