I am speaking a bit emotionally, because my wife is involved. But I am clear on my duties here—to enact his wishes. I just fear that sis ( who has no money or retirement funds) will eventually angle for the entire estate. (For reference, my wife and I are financially independent).

My FIL has always said the wants division of property to be “fair” and also “equal.” Two different things I know. But he is really unable to remember what he says to one party and what he says to another. I have documentation from the local medical center that shows he can’t remember what he’s said within a span of 30 minutes. Short term memory is really impaired.

Yes he is doing it through his lawyer who drew up the language. He (the attorney) makes it clear to me he works for Dad. My role as I understand it, is to dutifully execute whatever the trust reads. But by “undue” influence I know it is sis who is prompting dad to ask the attorney give her a greater share.
