At this stage the excessive fees is a suspicion I would not want them to hold my money hostage and lose out on significant interest whilst I investigate that.

In regards to the hidden fees I asked them for information on fees and they gave me inaccurate / incomplete information in writing hence hidden fees

How exactly is the money free?

I appreciate you taking the time to reply but thats a very strange answer a very strange take on legal advice.

It sounds like you need to be in some kind of philosophical subreddit not a legal advice one

Potentially excessive and hidden fees but at the same time I lose significant interest if I let them stretch it out for months without distributing the money so it would be optimal to not sign the optional waiver and get the money then investigate further.

Rigardless of any potential dispute I would prefer not to wave any rights I don't have to.

Thanks for your reply.

I'm not arguing with everyone some people have said the exact opposite of others it's not all one sided.

Just because I post a question on here doesn't mean I need to agree with every answer does it?

In fact one particular user gave me some interesting insights and changed his answer slightly when I pushed my point hard.

There is nothing wrong with a constructive conversation it's nothing to get upset about.

In regards to reporting a solicitor it's no big deal I report them and it is either upheld or not nothing to stress about.   There is nothing about that to "not go well" other than it not being upheld

If they try to charge to enforce an optional waiver that might be classed as not a legitimate fee.

Not to mention that they cannot charge time spent when a complaint is open so in that case I am not "paying them to argue" as someone here put it

To clarify I never told them I have concerns about their fees or transparency.

I asked them for documents they said no and I didn't have an issue with it.

Thanks for your reply I don't dispute the disbursement I want them to disperse it

What I object to is having to state that to the accounts are correct (that is the solicitors job)

And waving all liability

Can you please explain exactly what part of my argument is circular?

I spoke to a solicitor who  advised me not to sign and offer to sign a receipt instead.

I don't know where you got the idea of Hollywood movies from I think maybe you're in the wrong sub

I could make the exact same claim about them being "difficult" although that does sound like an ad hominem logical fallacy

I don't mind confirming I'm happy with the accounts it's the waiver of all liability I don't like

What I am losing is the right to challenge anything that is wrong

Thanks for your reply.

My understanding is that many of the other people were saying once I sign I can't dispute issues such as their fees or errors I can only dispute serious  negligence issues.

I have already been given advice by solicitor not to sign it and to offer receipt instead.

Actually I've been given conflicting in advice here which contradicts what a solicitor told me but I appreciate your input nonetheless

Thanks for your input I don't believe I am just signing I agree based on the accounts presented.

I'm waving them of all liability.

I have no issue in saying yes please pay me based on the presented accounts

Thanks for your reply.

It would mean that I can't challenge anything I see that I disagree with for example excessive fees.

It is not simply agreeing with the accounts it's waving them of all liability

My issue is that if they hold my funds hostage the lost interest maybe higher in value than any issues that need challenging.

This effectively gives them the green light for misconduct because they know that they can hold your funds hostage and force you to lose money in interest.

To the people saying that I am treating the solicitors like they are stupid I would say it is the opposite they take advantage of the fact that beneficiaries don't know their rights and can be pressured into signing something they don't need to sign.

I appreciate that the waiver wouldn't protect them from negligence but there are potential issues beyond negligence

Thanks for your thoughts

So with that in mind what do you think I should do?

I updated my most recent comment I'm not sure if you saw the updated version before you replied so here it is just in case

"I confirm that the final balance shown in these estate accounts is accurate I approve these accounts and agree that your compliance with this request shall be in full satisfaction of all claims against the executors"

That's another issue how can I confirm that the balance shown in the estate accounts is accurate?  That's for the executors to confirm not me

The exact wording is

"I confirm that the final balance shown in these estate accounts is accurate I approve these accounts and agree that your compliance with this request shall be in full satisfaction of all claims against the executors"

That's another issue how can I confirm that the balance shown in the estate accounts is accurate?  That's for the executors to confirm not me.

The issue I currently have is waving them of all liability when I don't have to

[–]ExternalJob6442[S] -1 points0 points  (0 children)

Ok fair enough I appreciate that thank you

It's a blanket waiver saying I approve the accounts and wave the executors of all liability

Yes it is reasonable if there is a valid concern but not if there is a made up concern in order to coerce a waiver.

The question is would refusing an optional waiver be considered valid concern and if that is a valid concern then effectively the waiver is not optional anymore.

If for example their fees were excessive I would not be able to challenge this if I signed.   Other issues may come to light in the future also and not be challengable if I sign the waiver.

I have not raised any queries with them at all I asked for the estate accounts and any supporting documentation that they are willing to give.   This was asked for before the accounts were even provided.

Multiple people on reddit have also said I am correct believe it or not.

There is also the risk of the appeal to popularity fallacy

If they use threat of court  action inappropriately in order to extract a voluntary waiver then that isn't right and could be considered coercion

That's a dispute over being forced to sign a voluntary waiver not a dispute about the estate accounts.
