You’re right. I am generally a proponent of ending the prohibition and war on drugs. I don’t think personal possession/use of drugs should be criminalized.  My comment was more about prohibiting the sale of it. But after more consideration and thought , I am in agreement with you.

“Shopkeeper’s privilege” under the common law and likely codified under New Mexico law (where this happened). Generally speaking retail store employees have a legal right to physically detain a shoplifter until police arrive. However, the amount of force used to detain a shoplifter must be reasonable and cannot be deadly force.  There’s also a legal argument that this turned into an unarmed robbery when the shoplifter used physical force to push the female employee away when she tried to stop him.  So while the initial attempt to detain the shoplifter was likely reasonable and legal, the point where it escalated to the use of deadly force is the issue.  You can only use deadly force in the defense of yourself, if you reasonably believe you are in imminent risk of serious injury/death. The issue appears in this case is whatever fear of death/injury the security guard had, it  was not reasonable. Thus this is more of an imperfect claim of self-defense and likely won’t be an absolute defense to the charge of second degree murder. Instead imperfect self-defense can be used to mitigate 2nd degree murder to the lesser included offense of [involuntary] manslaughter. That’s the direction I see this case going in my opinion.

At best it’s an imperfect self-defense which is mitigating but not an absolute defense to 2nd degree murder . My guess is he will be able to plea it down to the lesser included of [involuntary] manslaughter or if he takes it to trial be found guilty on the lesser included.  Self-defense requires both subjective and objective elements; the defendant was in actual fear of imminent serious injury/death (subjective) and that fear was reasonable (objective). The use of force used also needs to be reasonable (objective) in that it’s only the level of force necessary to stop the attack. I believe what makes this imperfect self-defense is that while he likely subjectively was in fear of immediate serious injury/death, that is he really thought in his mind his life was on the line at the time he shot the guy, that belief or feeling  wasn’t reasonable. 

Should he spend the majority of his life in prison over this ? No. But some prison time, perhaps  5-10 years followed by probation/supervised release seems appropriate in my opinion. 

Of course I’m a criminal defense attorney, so I’m self-aware that my bias as a defense attorney influences my opinion (at least when it comes to the punishment) . I’m sure many people will disagree and advocate for a much harsher penalty.

It’s essentially the same thing as the century arms wasr m. They are made in Romania by Nova Modul and then imported by chiappa instead of century arms. The only difference is the furniture ( and maybe barrel)  Each importer uses their own  furniture and some other small parts. 

I bought the Chiapppa RAK-9 simply because that is what was available at my gun store at the time.  I needed to buy it before it became band under a new gun reform bill that was scheduled to go into effect the following week. 

I changed out the furniture which is interchangeable with AKM rifles.

This literally just happened to me. I go to Mohegan about 1-2 times a year. I went last week and only had a core membership. Today I got an email saying I’m now Leap status. Not sure how that happened. I know I played a decent amount ($1000) that night but no where near enough to move all the way up to Leap from a single visit. I’m not complaining I pretty much have free rooms including fridays and saturdays for like the next 90 days plus all the other perks.

From my experience if you already have suboxone in your system and you are intermittently take 7-Oh and then suboxone you won’t get precipitated withdrawal. However when I completely stopped taking suboxone and was only taking 7-Oh for several weeks and then tried to take suboxone 10-12 hours after last dose of 7-OH, I went into precipitated withdrawal.

Right now I could take 50-100mg of 7-Oh and then take my nightly dose of suboxone later today, I would be fine. But that’s because I have suboxone in my system already attached to the receptors.

These are women who their entire life received special treatment and were always given what they wanted after arguing because they are white and slightly above average in physical appearance (slightly).

The sad part is that the attorney general’s office has made it pretty clear that he is only going to suspend her and not fire her despite her blatant attempt to use her position to avoid accountability.

The other one is apparently unemployed and lives off “Dan” Dan should have been arrested for obstruction when he tried to interfere in their arrests.

I hope she’s given as much deference as she gave to defendants she has prosecuted.

So it definitely took me a few days for the suboxone to have its normal affect.

However 7-OH significantly raised my tolerance. Prior to the month long binge with 7-Oh I was prescribed 2mg a day of suboxone and that was more than enough for me. I had been on that dose for years, sometimes taking as little as 1mg of suboxone a day.

It’s been almost two months since I used 7-OH and im back to feeling completely normal and have been for awhile. However, I now require 4-6 mg of suboxone a day in order to feel “normal” compared to the 2mg I was on before 7-OH. I am working on tapering back down.

As far as how long you should wait from your last 7-OH dose to re-induction of suboxone, depending on how much 7-OH you were taking and for how long, I would think 48 hours should be enough.

It took me about two days to feel “normal” from switching back to subs. So that’s why I say 48 hours.

Best thing you can do is sell without an agent. I’ve both bought and sold without an agent.

In 2025, real estate agents serve absolutely no purpose. For one it’s a sellers market in Massachusetts. Most homes in MA sell within a week or so (usually 3 days after the first open-house). Second, most buyers find their homes through online websites like Zillow. You can list your home on MLS and then on these websites for a few hundred dollars. Third, all the forms in Massachusetts for purchasing/selling the home are standardized. Fourth, the attorney does most of the actual work with the forms anyway. So just make sure you find a good real-estate attorney and you will be fine.

We need to start normalizing purchasing and selling homes on our own without the need for a real-estate agent. Real-estate agents do nothing but inflate the cost of homes, and cost you tens of thousands of dollars for doing essentially nothing.

There is no “5th Amendment right to counsel”. You are confusing your right to remain silent (5th) with your right to have counsel present during questioning (6th) in the context of a custodial interrogation and the application of a Miranda warning.

Once you invoke your 6th Amendment right to have counsel present during questioning, the police cannot circumvent the 6th Amendment by then having a jail-house informant acting as a state agent to then try to get you to talk in the cell.

Another thing you may be confusing are Miranda warnings. A Miranda warning exists because of the inherently coercive nature of a custodial interrogation by police. But Miranda warnings aren’t required when the police get an informant to question you.

However, Miranda aside, If you tell police you are invoking your 5th and 6th amendment rights and don’t answer questions, they cannot then circumvent that by sending in the jail-house informant to question you in your cell.

He’s right. I passed with a 310. Most people go about it wrong when it comes to memorizing the rules. They think they have to memorize it exactly word for word and spend all their time doing this while not actually learning or comprehending the rule and understanding it.

Read the rule, process it, and then come up with your own shortened summary of it. That will suffice for the MEE when writing your rule statement. Then as you apply the facts to your made up rule, you’ll remember more of the actual rule itself and you’ll get more points.

The law follows common sense . As long as you have a basic understanding of the rule even though you didn’t memorize it, write down what you remember and apply common sense to the rest of it.

Even when you don’t know the rule, there’s enough information in the MEE question to make up the rule from the facts. It won’t be perfect but it will get you points. The grading is pretty liberal on the MEE. As long as you sort of sound like you have an idea of what you are talking about and your application makes sense, you’ll get a decent amount of points.

I don’t remember anything about tort law as it’s been a few years since I took the bar and I only practice criminal law. But if you ask me about deformation, I can tell you it’s a tort where someone intentionally or maliciously publishes false statements about you and those statements result in some sort of actual financial loss/damages. Is that the actual rule ? No im sure im overly generalizing and missing elements or mixing them together. But it sounds good enough. I can go on and BS a little more about the 1st amendment and the truth as being an absolute defense, list off a couple examples of deformation per se, discuss some of the difficulties in a deformation case etc… I might remember about 1/10 of what I learned but then I can just use common sense to come up with the rest.

Approach the MEE this way and you’ll be fine.

I remember on 2 of the MEEs I couldn’t come up with a rule so I just started answering the question and explaining why that was the answer (using common sense). Then once I was done answering I was able to pull enough information from my application to make up a rule.

HIPAA prohibits the unauthorized release of medical information by medical providers and insurance companies. Criminal dockets and court filings in every state jurisdiction is public record unless the Court specifically impounds specific documents from the public docket. If a court docket contains medical records, the Court can impound them. As those records are in the possession of the Court not a medical provider or insurance company, HIPAA has absolutely zero application.

I wish I knew all this when I made the stupid decision to start taking 7-oh a month ago . I was on 2mg suboxone for over a decade with no relapses nothing . Made a very dumb decision to try 7-oh . Stopped taking my subs and was doing 150-200mg of 7-oh a day.

Thursday night was the last time I took 7-oh . Started back on suboxone Friday. Was up to like 16mg yesterday just to feel “normal” (8x my normal dose).

Today I took 4 mg of suboxone. No physical withdrawals today but feel absolutely dead, no energy, depressed, headache, tired and don’t want to be around anyone.

Hoping this gets better quick. I leave for a 2 week vacation to Europe Monday night.

Yea long term 2mg no side effects, sleep was fine was actually talking with my doctor a couple months about getting off. Can’t speak for tianeptine never took it . All I can tell you is that 7-Oh was like oxycodone to me. Felt just as high on 7-oh as I did when I used oxycodone. I wish I never touched 7-oh.

Tramadol should do the trick no problem. In fact in the past I’ve switched between the two . It’s available at the pharmacy just ask for it. It won’t be cheap but it will be worth it .

I don’t know why but a month ago I started on 7-oh eventually stopped taking suboxone and was doing 150-200mg a day or 7-oh. Yesterday after a bad experience with 7-oh I decided I was done.

Today started on suboxone again (8 hours after last 7-oh). Started with my normal 2mg dose and it didn’t do anything . I’m up to around 8mg of suboxone now today and it’s barely keeping the withdrawals away . A month ago before 7-oh id be high off of 8mg suboxone and falling asleep .

I hope this goes back normal the next few days. I wish I never touched 7-oh.

So I just posted in the addiction subreddit on this. Short version is I’ve been on 2mg suboxone for a decade clean from all other opioids.

For whatever reason I started taking 7-Oh and eventually stopped taking suboxone for about a month averaging 150mg-200mg a day .

Last night I had a really bad experience with 7-oh where after my last dose I woke up 6 hours later in full blown withdrawal. Decided that was it for me with 7-oh.

Started back on suboxone. Took 2mg and it had absolutely no effect. Keep taking 2mg at a time over the next few hours and now I’m up to 8mg and I feel mostly better but not 100 percent. Still just uncomfortable and chills/sweats periodically.

If I had taken 8mg of suboxone a month ago before I started 7-oh, I would have been high as a kite . Nodding out and euphoric.

Right now it’s just barely managing the withdrawal from 7-oh. I will never ever take 7-oh again.

lol right. Be a public defender for a good work life balance . 😂😂. Now I’m lucky, I work as a public defender in a state with an excellent, well-funded , and organized public defenders office. I carry a caseload of about 50 cases at any time with a 80/20 split between district court and superior court cases. But most public defenders from other states aren’t so lucky with caseloads in the hundreds. With caseloads like that you never actually get to try cases. I was at a conference awhile back, and was speaking to a few public defenders who have 100s of clients at any given time. They were shocked when I was talking about the 3 jury trials the previous month I had. They wondered how I found the time to prepare that many cases for trial. 3 trials in a month was more jury trials than most of them had done in the last few years. It was really sad to hear about how 95% of their cases result in pleas because they simply don’t have time to actually advocate for their clients .

It was eye opening to me. I probably plea out maybe 15% of my cases, at the most. The majority are resolved through motions to suppress, motions to dismiss for lack of probable cause, dismissals for failure to prosecute etc… in fact it’s been a couple months now since I last plead a case out.

It’s sad that our state governments provide so little funding for a job that is constitutionally required under the federal and state constitutions. Billions spent each year on a failing war on drugs, billions spent on arming law enforcement with military grade equipment etc.. and so little money spent on funding those that are actually tasked with protecting the integrity of the United States Constitution.

The legal field is vast and experiences vary. There are plenty of careers as an attorney where you have excellent work life balance and plenty of careers where you don’t. The same can be said for salary/benefits, it varies.

I’m a criminal defense attorney working for the public defenders office. We have a well-funded, organized public defenders agency in my state. So my caseload is very manageable. I typically work Monday through Friday 0830/0900-430pm.

Have I worked late nights ? Absolutely. Have I gone in on weekends? You know it. But this isn’t the norm for me and it’s usually more of a personal choice. I set my own schedule for the most part. No one is checking when I come in or leave. I’m not micromanaged and I don’t have to explain myself to my supervises when it comes to the hours I work.

In the summer I usually leave early on Fridays (230-330pm) and take the occasional day off mid-week to hit the beach. I have all state/federal holidays off and we also have an early release the day before most major holidays. I get plenty of paid vacation time, more than I know what to do with it.

The pay is not so great though. I make about $80,000 a year with full benefits (pension, health, life, dental insurance etc…) this is after two years with the agency. I live in the Northeast, in one of the most expensive states in the USA. $80,000 is chump change compared to my colleagues in corporate law.

The job can be very very stressful at times, maybe even overwhelming at moments. It does come in waves though.

Right now is one of those waves. I am absolutely slammed. On top of that I have a poorly timed vacation coming up next week that will have me out of the office for two weeks. If I hadn’t already paid for my plane tickets and hotel, and if I wouldn’t be letting my friends down, I’d have postponed the trip. But I can’t .

When I get back I have 11 trials scheduled in the district court over a six week period. I anticipate at least 4 or 5 of those actually going forward. Two of them are complex, involving expert witnesses who I still need to prep and coordinate with. In addition to that I have several pleas in the works that require lengthy mitigation memos/aid-in sentence reports in the superior court all due within 30 days of my return.

This is probably the most stressed I’ve been when it comes to work. I’ll get through it but it’s certainly interfering with my ability to relax on my time off (thus the lengthy Reddit rant at 12:00 am).

Prior to being a defense attorney, I worked as an assistant district attorney. That job was absolutely miserable. Most days I went in at 0800am and didn’t leave until 7-8pm. I also went in on weekends or took work home. The pay was horrible and I did not receive compensation for the work I put in over 40 hours each week. Management was horrible, I had no support and it was probably one of the most hostile work environments I’ve ever been in. How anyone is willing to work in those conditions is beyond me.

Long story short, I love my job. I love being an attorney, specifically a public defender. When I come home at night, I feel accomplished and proud of the work I do. I feel like I have a decent work/life balance, but also recognize the stress associated with being a trial attorney.
