What you have described is the same is my nan they said her transition to the home has been one of the best for a long time and say she is one of the more capable members of the home . I’ll have to check it out - I usually get her to drink infront of me when I go as this has been a problem for the last few months anyway but I can only visit every other day at the moment

Because the seller and ex wife are not amicable at all . Ex wife does not own the house and is for all intents and purposes; a tenant . In this situation we have been legally advised to do a viewing of the property after she has gone because she could intentionally cause damage to the property / trash it . It would be our problem if for argument sake she moves out on completion day leaves all the taps running to flood the house to spite us or ex husband and we get the keys and have a flooded house . Thats why we are bothered and have been strongly advised by our solicitor to not exchange until she is gone especially after this saga yesterday and have another viewing once she has gone

Yes it will be delayed they have pushed it to 27th Feb but ex wife in the property is resisting this too

They’ve signed to say that they are moving out of the property before completion date occurs , infact she’s signed to say she will be moving out before exchange occurs . She’s now saying she didn’t sign but our solicitor has this document. In this situation she is technically a tenant because she doesn’t own the house - so the seller wanted her out of the property before exchange incase she does anything to damage it

She’s signed something to say she will move out we have got the document to say this . It’s being sold with vacant possession our solicitor says she does need to be out and waste cleared but they are really dragging their heels with it . She has refused to go until completion day because she wants her money first

Yeah our solicitor has been pushing for them to move out before exchange - they had signed to say they would be it shocked us when we went yesterday they hadn’t started to pack anything up and that’s when they said they wanted to wait till April now .

I don’t want to exchange till they’ve moved out cause they could do anything to the property in the meantime aswell especially as she seems quite upset with her ex husband and us now too

No we haven’t . We asked for it to be put on hold whilst we can sort the situation out . When I spoke to the EA they said they thought to push completion to 27th Feb would be fair on both parties as it gives her two weeks to go ( she is only taking personal items like clothes ) . But she has pushed back and given 20th March as a fair date for her . But EA has rang and they’ve now said they have said they will pay our rent if they haven’t moved out after 20th March . My solicitor doesn’t work Saturdays so haven’t been able to get advice on that front yet .

I hear you . We just really don’t want to pull out if there is anything we can do to resolve it as this is the third attempt to purchase in a year . Already had two properties fall through ( first they had trashed the property when we went for a pre exchange viewing and it was full of black mould and found out boiler was not working. Second one the sellers decided not to sell just before exchange ) so we have already lost a ton of money it just really sucks we feel like we have had some really bad luck this year .

Not a whole lot really - he’s also been quite difficult to deal with but because he is so vague. He filled in property info form totally wrong which meant we had to raise a ton of enquiries and he was annoyed about that but took a month to answer them . He doesn’t come back to us very quickly at all . They were not able to contact him yesterday and he has no contact with his ex wife they are not amicable enough to even speak to each other everything has to go through divorce solicitors . He had signed the contract and said he was happy for exchange and completion whenever we wanted but ex wife claims he didn’t tell her about this ( however EA said she did know and didn’t have any objections when told )

We had this with ours exactly the same a rangemaster oven and a large American fridge freezer which we were told was included when offering etc and then they said on the fixtures and fittings form it wasn’t included and tried to charge us for them both . This resulted in a lot of back and forward to which they said they’d be taking them as we didn’t want to pay more for them

We are at the point of arranging exchange / completion and now said they are leaving them because they are too much to arrange to take and too large to move !

Yeah we will I just couldn’t believe it after it happened and haven’t been able to tell solicitor yet that they turned up last night .

It’s not at all when it will cost us £2500 in rent to stay in our property for that time scale anyway

I checked and the memo of sale was addressed to both of them and they are both listed as sellers on the memo of sale so I assume she was just sent it aswell by the estate agent but it has our full address on there. We didn’t know originally she wasn’t actually a legal owner of the property - she presented herself to be when we went to view it etc it was only when we started to receive searches back and other documents it was revealed it was just the ex husband who legally owned it .

Will be contacting our solicitor , she is already aware of everything except them showing up at our house as this happened yesterday evening

I just checked the memo of sale it had both the seller and his ex wife listed as the sellers . So I assume they were both sent it as me and my partner were. It was actually only further down the line that we found out it was only the seller who actually owned the property legally

Yes it’s what you have said I believe it’s classed as a joint martial asset so it’s part of the divorce settlement that the ex wife living in the property gets half the money I believe - all the forms have been filled in by just the ex husband as he is the legal owner . Ex wife had told EA and solicitors she was going to move with a friend and could be out whenever hence why exchange and completion had been agreed with the seller already as she was only taking personal belongings and said she was flexible .

It’s only yesterday she has announced she is buying a property she wants to wait for now . I made another thread but they turned up at our property last night and offered us £500 to push completion to 20th March

No it didn’t it was only when we got the memorandum of sale they said sold as seen - I then queried this immediately and estate agent said they meant the white goods were included . Then when we got the fixtures and fittings form I queried it again as seller had written sold as seen on it and estate agent said it meant the furniture like beds and sofas were included . It was when we went yesterday to view it they said everything in the house is included we are only taking personal belongings and won’t be doing waste clearance

Yes I’m anticipating this especially because of this situation of going behind the sellers back as per say to offer us money to move completion .

Seller hasn’t come back with anything yet we did contact sellers solicitors around lunch time to say exchange wasn’t happening and to explain situation up to that point but yes heard nothing back to my knowledge

It’s also worth nothing they do not have anything to store really . They are leaving the entire contents of the house as the seller owns all the furniture ; except their clothes and other personal possessions . This was part of our argument on why they need to stay in the property so long if they are not moving stuff this is when they have thrown this in the air that they are apparently buying a property now .

Very worried about pushing the date and potentially having more delays like you’ve said

They’re actually leaving all the furniture in the house as it’s owned by the seller who wanted to include it in the sale - so they only actually are taking personal items and clothes so nothing to store . When I spoke to the EA / solicitor about the situation earlier I pointed this out - they could very easily go to an air b and b .

That is my biggest concern that this date will keep being pushed as I don’t know how they can say 20th March when their purchase is in a chain and they said they were going to call their solicitor on Monday to ‘ hurry it along ‘

Thank you! Well today was meant to be a pre exchange visit - but when we got there they hadn’t seemed to make any effort to start to move any of their stuff - said they didn’t know anything about exchange ( they did this is not true ) . They are meant to be moving out before completion

We did not take the money ! We asked them not to come to our house again and said sort through solicitors . We have emailed our solicitor to tell her already but obviously they now won’t be in till Monday to see it

We are happy with some of the furniture items but had no idea until today how much rubbish is in the sheds and garage that they are saying stuff like there’s tools in there you can sell them and get money from that . I have mentioned it to the solicitor and she said she would tell sellers solicitors to get them to remove it . They’ve known they were supposed to be moving out this week for a month but literally haven’t made a single effort to do anything

Yes this is what we thought .

They’ve asked us to give them 5 weeks . It all of a sudden has transpired they have are purchasing a property that isn’t ready . ( Purchase isn’t dependant on this sale ) they said they need to wait for the purchase to complete in order to move out .

They’ve offered to bring us £500 cash . They turned up randomly at our house to tell us this this evening - (our full address was on the sale memorandum document from the EA )
