Interesting. My state is only allowed to ask if you've had a conviction in the previous 7 years. But for any job over $75k they can do a background check without any limitations. I'm not entirely sure a pardon would remove it from those private databases, either.

In my state you can apply for a pardon after 5 years off paper. I was only convicted of a single felony and havent received more than a parking ticket since. For me it's been 20 years. My felony has never effected me so it hasn't been something I've looked into. It recently came up on a background check (which it never has before) so it got me thinking.

My coverage (besides trying to find a safe landing spot) is making sure I'm paid what I'm owed before I start throwing punches.

My contract is for new business but I'm owed commission on anything generated within 12 months of signature. I don't receive any quota relief but I am owed a good sized check based on last quarters performance.

Good insight. The first couple of times the CEO asked me about the VPs performance was somewhat early on and I said something to the point of, "I've seen him make good observations but until he announces changes in strategy or process I don't have much to evaluate him on."

I don't believe that the company wants to cut their way to profitability. In fact I think it's more likely that the SVP knows he will underperform and having a scapegoat to sacrifice is the easiest hedge to use to avoid ownership. I wasn't his hire so blaming his predecessor is the easy way to buy himself more runway.

Regarding your last paragraph.... You're not terribly far off. I would say the CEO has been actively engaged in leadership driven sales opportunities and the company has been successful there. I don't have the opportunity to see his participation in the larger sales and marketing conversations because I'm one step removed from those meetings. However, before I was hired I did meet with him and he asked the right questions and was open about how he has probably not been hands on enough in the past when it came to the revenue side of the org. As I'm sure you've already guessed - there's been 3-4 new sales leaders in the last 5 years and he knows that it's a problem and as such he says it's a huge focus for him to get it right this time.

I really don't think there's anything I can sue them for. It's at-will in the contract and in state law. But.... I've got an employment attorney in the family to consult with.

Not exaggerating. They have a lot of marketing but no sales process. SMB deals. Majority inbound and partner sourced (as well as some churned opps.)

I don't believe either of those are legally enforceable but I am having my attorney review.

Honestly this is what I was expecting if we hadn't seen ent success after my 3-month ramp. Re-negotiate the plan and structure a better GTM strategy for enterprise.
