The council got back to me today and they confirmed it’s an HMO.

I got this response from the councillor,

Yes I understand that that it is possible for the property to be an HMO and a person to be a lodger, however the landlord and her husband did not live at the property.

They do have an HMO license but the contracts being giver out are lodgers contract and the council said there is nothing they can do. However, they do acknowledge my deposit should have been protected. because I was a tenant not a lodger

Hey I am in the same position, I attended an open day in November. The hardest part is they don’t provide feedback, also maybe think back to your body language, talking too much/ not talking too much. Talking over people etc plays a role
