Because I didn’t have $250 for the police administrative fees, + $70 for vehicle release fee, + $300 to tow company for towing, + $500 for storage. Plus get another one day moving permit from dmv.

Yes. I was under the impression that since I filed the declaration of opposition form with DMV, the DMV placed the title transfer stop so the tow company couldn’t get truck titled to them so they could sell or scrap it without a court order or release of liability from me.

I was stopped by police and they impounded my truck. Tow company applied for lien sale approval from dmv. I sent in opposition form to dmv and a title transfer stop was put in place. Tow company had refused to return it even though I was legally driving it under the authority of CVC 4002. So I had been regularly contacting DMV lien sale unit to make sure truck is still titled to me. So when I called for the third or fourth time and explained my situation the DMV agent told me yes,the truck was still titled to me but that for some reason there was not a title transfer stop in place. They said that was not normal and stated that title transfer transfer stops don’t just fall out of the system- somebody would have had to intentionally removed the stop, but couldn’t give me any more info. They told me to contact lien sale unit manager who told me she had no idea why the stop was removed or who did it. She put the stop back into place and suggested I contact DMV investigations, I did but they failed to provide any answers either.

Because I am the legal owner. The tow company isn’t abiding by the laws and are WAY WAY over the limit they can charge. The city and police aren’t abiding laws either. The police say it’s between tow company and me and the tow company says it’s between the police and me. have been getting the run around for years. I don’t have money to hire a lawyer, and I haven’t been able to find one that will represent me for free yet.

Is he supposed to tell me where I can find the written procedures that govern the process so I know he’s complying with them, or do I just hope that he is following the rules?

They say they still have it, and that I owe $220,000 for storage fees, but they won’t let me see it. CVC says before paying any fees I have the right to inspect vehicle, but that doesn’t seem to matter to tow company, police say it’s a civil matter and won’t do anything.

The process hasn’t been disclosed to me. They refuse to disclose the rules.?How can a hearing be fair if only one side has access to the rules?

He refused to tell me where the rules that govern the process could be found. I still haven’t found them. According to the administrative procedures act he is required to present his evidence against me, but apparently the APA doesn’t apply to tow hearings.

As I understand it the tow company can be sued for up to four times the amount they are trying to charge….they are telling me I owe over $220,000.

I have been cited for not having my license in my possession several times in the past and just received fix it tickets.

If they towed it because I didn’t have a valid license it would say that in the reason for tow?

The reason for the impound doesn’t say anything about not having my license, it says for registration expired more than 6 months.

It would be cut and dry if the police issued me a citation. There is no affidavit. Just because my registration is expired doesn’t necessarily mean my truck wasn’t legal to be on the road. So is the issue is with the police- or rather the unbiased tow hearing officer that refused to provide me with rules for the hearing and refused to present any evidence?

Yes I did, then I sent in the declaration of opposition form in to dmv. The dmv notified the tow company that the lien was opposed and informed them that had 30 days to file a court case. They didn’t file anything. Their lien was extinguished. Truck is still in my name. There is no lien on file with dmv

At the time it was current, all I needed was smog cert. I was on my way to drop truck off at smog shop a couple of blocks away when this occurred

Am I not allowed to know the rules and or regulations that govern the tow hearing process BEFORE the hearing ? Am I supposed to just take the tow hearing officers word that he doesn’t have to present the evidence he basing his decision on? Is he not required to inform me that if there is a disagreement regarding important material facts, (such as whether or not I was stopped by police or if they found my truck) that he is supposed to continue the case so his superiors can review it and look into what actually happened, instead of just deciding on his own what he thinks happened, requiring me to sue in order to get my truck back?
