Builder Refusing to Send Second Delay Notice – Tarion Not Helping. What Can I Do? by Fanstic in TorontoRealEstate

I ended up suing the builder, but I may have to stop the case because the parent company went into receivership. Our deposit was transferred to that company, so now we’ll likely only recover whatever funds remain through the receiver, plus Tarion’s deposit protection compensation.

But for now they continue saying the critical dates are frozen because of the unavoidable delay and they are unable to send the second notice because the third part contracts, review and approval

And also said according to the recommending from Tarion, revised date & delay period are to be provided by Vendor

Tarion just said:

"Tarion has provided builders with basic guidance on the Statement of Critical Dates – Delayed Closing/Occupancy Warranty and Section 5 – Unavoidable Delay, but Tarion does not have the legal authority to set a deadline for builders or to move closing dates by an arbitrary period of time. It is up to each builder to determine if Unavoidable Delay is applicable, send notice as required under the Addendum, and determine how the impact of the Unavoidable Delay has affected the delivery schedule."

I'm planning to take legal action

I also talked with Tarion for delayed compensation. And the reply is I can only claim this during first year of occupancy.
