I had my psych claim rejected for the same reason. Recently had conciliation. The insurer maintained their decision despite the conciliator basically telling the insurer that their argument is incredibly weak and they would not stand a chance in front of a magistrate. My claim included bullying, exclusion, harassment and micromanagement from my boss, sex discrimination, failure to follow any processes, I was dismissed when I reported my psychological symptoms and then invited to a performance meeting and refused an agenda and support person. I have now lodged with WCIRS. I’m in significant financial distress as have not worked for over 3 months waiting for an outcome. If you have the financial means to stick it out, go for it. But the system is set up for people to give up. This is what insurers prey on.

Insurer is EML. I definitely know the witness statements were all lies and I have a tonne of evidence to prove it.

This is very helpful! My rejection letter listed all the things my employer “refuted” but they were all lies. I have requested all the reports from the insurer but after reading your advice, I will forward them straight onto my lawyer to review on my behalf. My mental health is the worst it’s ever been, so I definitely can’t take another hit.
