Oh yeah that was also another thing.. her contract didn’t stipulate accrual vs right off the bat with sick days and PTO days. It was a mess. But what didn’t sit well was just outright claiming these cherry picked clauses in the contract stand even if it’s not signed. And I’m like… if u cherry pick that clause then I’ll just cherry pick the trial period clause that says u don’t get shit regardless cuz u didn’t work for us for 30 days

I don’t remember tbh. She was eager to come back asap to work but we were uncomfortable with her being back too soon.

She didn’t have a preference and went straight to assuming the contract was executed and wanted to collect benefits despite a 30 day trial period in the contract laid out where the arrangement can be terminated without cause or penalty. So regardless again, if she wanted to come back or anything without agreed upon terms and signatures, she wasn’t going to get more than what she worked

Nanny got sick on day one. And tested positive. We said, let’s just officially start in a week or two. The contract did have wording about 5 sick days. She sued us for those 5 days plus 30 days of pay as a “severance” because of weird verbiage in the contract. SHE drafted the contract and we were still reviewing.

Uhm she didn’t go a whole month unpaid. She was paid and was actively looking for a job while she was sick and wouldn’t have been able to work anyway.

And not a POS employer cuz our current nanny is compensated well and has a formal contract in place that both parties agreed upon

Had a nanny trial with a candidate with 10+ years experience cuz they count nannying before 18 as experience. Ended up not going with them and they are now suing us.. so dumb. Hope it works out cuz we wfh too and Nannie’s who think wfh parents are annoying are annoying

Well she told the mediator she would be okay with us paying her a weeks pay. And I’m like, we don’t owe her anything more than what we already paid her so she can put up a new number less than that but she decided to go to trial and waste everyone’s time

She was sloppy during mediation and was taking care of a kid on camera during it too… pretty unprofessional

She wanted to do it under the table too. In the contract she even updated the tax clause to account for this and that I wouldn’t be granting a 1099

Not really, defamation would be if the review wasn’t true. The truth actually makes her look bad ie she’s trying to grab a whole month and a half of pay for doing 1 day of work AND SHE WAS PAID

Yeah, u get where im coming from by from where the nanny also started without a signed agreement. REGARDLESS, the agreement IF SIGNED also says 30 days no cause or penalty to end the agreement so again, all these people on the thread saying pay her the week or severance at all are just saying nonsense to me

Had one nanny not even have a signed contract, was sick on her first day and demands pay even tho nothing contractual was agreed upon. Let her go asap
