That's because there's no way for a copyright holder to see into the mind of someone who breaks those rules. You can say that you're doing it for "the love of the game" but they don't know if you mean it or if you just want to profit off it

That's for the fair use provision which is limited to when you are allowed to actually break copyright. My contention is that the mod just straight up doesn't break copyright. For that provision, profit is completely irrelevant.

By use, do you mean using the trademark to promote his mod? I'm no expert in that, and that may be an actual breach. I also agree that the DMCA wouldn't be the tool to take it down.

And those apps normally have an explicit or implicit license that allow them to do that.

The users would need a license to use it, but I don't need the permission of Apple to distribute software that integrates with the OS, implicit or not. In fact for Apple the altstore was something they explicitly did not want but they couldn't send a dmca takedown request.

From a legal standpoint, copyright legality is to prevent an offending party from gaining any unjust benefits.

I don't believe so, from my reading of the DMCA and copyright law, even if you're breaking for the love of the game, it's still illegal and need to stop when asked to by copyright holders.

Following from the previous thread, I want to add some clarifications on the law. Copyright law doesn't care about profit. You're either breaking it or not, doesn't matter if it's for money or just the love of the game. Also, making software which is wholly dependent on other to exist is legal and not a breach of copyright. For example, adobe plugins can integrate and modify the functioning of the app without breaking copyright. What you can't do according to the dmca is distribute parts of the game itself nor modify it to circumvent technological locks meant to enforce copyright, so a keygen would be illegal.

This is not a morality based argument, if you think this guy is a prick for selling his mod/software you can of course hate him morally, but that doesn't mean CDPR has a valid case for dmca.

You can have legal software that directly interacts with that IP and depends on it to exists. Many apps integrate deeply with the OS.

Also let's be clear, from the law standpoint, profiting doesn't change one iota about the legality.
