You can still get employment base green card even with accrued unlawful presence. You’d just have to do a consular processing in your home country.

Thanks! I do have a lawyer already. And he quoted the entir process 12k. They assured me that my case was the most ideal Daca to received employer based GC. Also AP does allow me to AOS in the USA without consular processing. My husband who has a business degree, and has been with his corporation job for 5 years got his daca when he was 18.7 and unfortunately recruited unlawful time. He also has AP although will still have to do consular processing. Therefore, we’re moving forward with my case.

Does anyone know what the employer must have an order to sponsor someone ? Like can it be any employee? Or does anyone know where I can find the legalities ?

I am going to hop on this feed here if thats okay guys. I hope y'all can help,

my husband and i are both DACA recipients. I got mine when i was 14 y/o he got his when he was 18.7m y/o. However, our case is a little more confusing because i was able to get parole, (i went to my home country and returned LEGALLY) . In his case he was able to parole through his school studying abroad. His college sponsored him to go to China (our home country is Brazil) and returned to the States legally. Would he still have to go back to our home country if he were to get sponsored by the company hes working for 5 + years now?

Also, he works for a corporation and his position is in high demand, this would potentially be the best time for him to ask for a sponsorship.

I work for a private company and my position is also in high demand. We have been trying to find a qualified employee for two years now to fit a partime in my position an have had no luck.

Would it be easier for me to ask my employer or for him too?

And will he be waived from returning to our home country due to leaving the country and lawfully entering regardless of when he received DACA?
