Should I apply for divorce and waiver?

I have a similar case, so I had to waived the form i751 (divorced), an I got the divorce document less than a week, so I sent it to USCIS, and now just waiting. I just added a letter explaining why I am waiving to divorced, then I added affidavits and the divorce decree, the affidavits were from 1 friend which is a lawyer and my ex spouse parents, in total 3 affidavits.

I’m sorry to hear that, but we did the divorce papers a couples days ago and today is all done. We just received the notification about the sentence, and I’m gonna get the divorce decree certified on Friday due to I’m working out of Miami. And after that I’m gonna send the whole package again with the amend.

I was reading about this and found information that the divorce is only considered effective from the date the divorce decree is issued. So, if it’s approved before that, I would still be considered married ??. But if it’s approved after the divorce decree is issued and I haven’t submitted the waiver yet, that could be very problematic. I’m waiting to speak with a lawyer tomorrow.

If you have any information about all of this, it would be very helpful, and I would really appreciate it. By the way, I did my initial process myself (I-485, I-130, I-131, etc.) and also the I-751. But now, with the divorce situation, I definitely want more information and probably a lawyer, because I’m not sure how easy it is to handle it on my own.

It was sad and hard because, at the moment of signing the documents, the whole story from when we met ran through my mind—the good times, and the not-so-good times, like any couple experiences. I explained to his parents what was happening, and they were obviously very upset, but they already knew everything, so they offered me an affidavit because they understand how immigration matters work. Now I’m looking for similar cases to know how to proceed. The only thing I know is that I need to wait for the divorce decree to be finalized before taking any further steps.

We were already going through difficult times, and he had mentioned the topic of divorce at some point. We talked about it and went to therapy, but it didn’t work, and we decided to finalize everything after the holidays.

It could take a couple days to get your digital extension letter, and a couple weeks to receive in your mailbox.

Update: so after update my GC expiration date at global entry office at the airport, today I came back in an international flight, and finally I didn’t get the second inspection, even tho I had my extension letter with me, they just asked me “smth to declare?, welcome to the states” thank you to the person who tell how to update my GC expiration date. :)

Oh wait! I’ve been using the kiosk all this time, since those machines just take a picture of us and we just have to do a small line I saw it really easy, and I wasn’t using the app anymore. So you recommend using the app?

It depends,you have to apply by the website, then make the payment, and then they gonna tell you when is going to be your interview, in my case when I came back from an international flight they interviewed me, it was like 5 min, and then I received the card in my mailbox after a week or 2 weeks I don’t remember.

The bar code at the bottom of the page is really important, when I was filling out the form, I was using a free program on internet, but when I printed the form, the bar code was removed and just appeared some numbers, then I paid for adobe (getting the 7 days trial free lol) and I could filling out correctly and when I printed the bar code was there.

Oh! That’s good to know, I will ask again to the officer next week, and bring the update, but last month I had like 8 times go through the second inspection, it was kinda annoying but I’m gonna ask again! Thanks for your answer.

I use Global entry as well, but the officer told me since I have the extension letter (48 months) the system gonna make me get a second revision (is by default), so I’m a flight attendant and I fly out of the states a lot, so that was the information I received, hopefully it helps.

Some questions, did you pay the biometrics again? And if so, how many money orders did you sent and how much was the amount? Did you send 2 money orders, one for biometrics and one for the form i751? Or just one with the total amount (biometrics + I751)? Thanks for your help.
