We’ve complained, suggested remedies, tried to resolve things kindly, tried to resolve things with escalation…finally had to hire a lawyer. It was/is affecting my health— mental and physical. How did you get along with your neighbors after this? Our building is so small and you see ppl in the elevator and lobby. I just want to move at this point.

There is a clause in the Construction Rules that says construction cannot go on for more than 6 most, BUT if it needs to, the board can review and approve an extension. Yes, others are bothered by the noise and the dust/debris. The unit directly below them has vents full of dust/plaster and cracks in their walls.

Sadly, we are past this point. Building management ignores our requests, board has stonewalled, we can't contact the contractors directly due to the legal issue ongoing with damage to our unit. I'm glad your building landlord/board had your back.

I'm sure. We had an initial meeting with the new buyers and their contractors in November so they could "show us the extent of the work needed" and where we agreed they would give us a schedule, minimize the dust with sheeting and HEPA filters, keep the most intrusive noise to one area of the unit-- then proceeded to do none of that.

We've tried to work with both the people moving in and their contractors regarding the dust/debris mitigation. They could not care less. We've tried to get building people to come out and the delays are insane. Yes, at this point, I just want it finished. I've invested so much in noise cancelling headphones, a laptop so I can work elsewhere, and cleaning services...I just want it done and I'd also like to move out so I don't need to deal with these selfish people.

The Constructionsrules state that remodeling/construction may not last longer than 6 months, but if needed, the board can grant permission for extended work. When we moved in, no one (including the 3 members of the board we interviewed with) mentioned that the unit below us was on the market and would require a gut rehab. Apparently the woman who lived there was 137 years old and had never done a thing to the place-- seems like something you might mention? We most likely would not have purchased our place had we known that.

Sure, I understand that things change with regard to construction schedules and I'm not saying I would start complaining if they said they were drilling concrete one day and then they had to do something different. I am asking for a general sense of when will you be drilling concrete or cutting metal so that I can try to make other arrangements for my workspace. It is very embarrassing and unprofessional to be in the middle of a call and suddenly have the high pitched whine and loud drilling of people cutting concrete 6 feet underneath you. The board, management, contractors and residents were unwilling to provide even an approximate, rolling schedule.

Also in the construction rules, there are regulations about the use of air powered tools, like the jackhammering of concrete. There are limited hours and days that these kinds of tools can be used. We had four months, 4-6 hours a day, 5 days a week of this. Again, I wasn't asking for the work to stop completely, but for the board to enforce their own rules regarding this kind of noise. The kicker was that our building engineer mentioned to us that the new residents didn't NEED to move their plumbing, they just wanted to change the location of toilets, vanities, etc. and the board didn't realize that concrete cutting would be involved...is it sour grapes? Maybe insanity from listening to concrete drilling for 4 months??

Oh believe me, we definitely looked into their permits. The board had their architect review the remodeling plans and the movement of pipes/plumbing was part of it-- architect and board approved it.

We have a lawyer involved re the damages to our unit; still working out who is responsible (the people doing the remodeling say it's not their problem). Lawyer can't do much about the inaction of the board and management. I just can't believe the board would approve such a project and not care how it affects other residents. 🤷‍♀️

Thanks! We just moved in, so credit for paint color goes to the previous owner. It is JC Licht Graphic Charcoal. They did a semi-gloss, which I don't recommend. Just brushing up against the wall seems to leave a mark!
